The report 10 alleged that Gary Alan Schultz violated Standards for Competent and Ethical 11 Performance of Oregon Educators by touching female students on the breasts, thighs 12 and hugging them; thereby creating a hostile environment of unwelcome touching and 13 comments. 14 After a review of the matters alleged, Mr. Schultz and the Commission have / \15 agreed that their respective interests, together with the public interest, are best served V16 by a stipulation of facts and a voluntary surrender of Mr. Schultz’ Oregon Teaching 17 License in accordance with OAR 584-050-0027. In entering into this stipulation, Mr. 18 Schultz waives his right to a hearing and understands that the Commission will accept 19 the voluntary surrender of his license and will revoke the license. 20 STIPULATION OF FACTS 21 1. On March 22, 2000, the Commission issued a three-year Professional 22 Technology with a Mechanical Technology endorsement Gary Alan Schultz valid until 23 March 22, 2003. 24 2. During the 1999-2000 school year, while employed as a teacher at Mountain 25 View High School in Bend, Oregon, Mr. Schultz inappropriately touched female students 1 STIPULATION OF FACTS AND ORDER OF REVOCATION - GARY ALAN SCHULTZ . 1 on the breasts and thighs, hugged them, and made inappropriate sexual comments to 2 them thereby creating a hostile educational environment. 3 3. On December 1, 2000, Mr. Schultz pled guilty to one county of Harassment in 4 Deschutes County Circuit Court. The Judgment of Conviction and Order of 5 Sentence/Probation suspended the imposition of sentence with supervised probation for 6 36 months; serve 2 days in jail, with credit for time served and an additional 30 days at 7 the discretion of the probation officer; completed 48 hours of community service; comply 8 with all conditions of Sex Offender Treatment including a Sex Offender Evaluation; have 9 no contact with minor females except own child and only in the presence of a third 10 party; and pay a fine of $65.00. I 11 Mr. Schultz enters into this Stipulation of Facts with knowledge the Teacher j .12 Standards and Practices Commission will revoke his Oregon Teaching License. This I 13 stipulation is contingent on approval and adoption of the order by the Commission. If 14 the Commission does not adopt this order, neither Mr. Schultz nor the Commission are 15 bound by these stipulations and he retains all rights to a hearing on the allegations. 16 lT IS SO STIPULATED: 18 Gary ‘,m'.
