I 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION I Q OF THE STATE OF OREGON i 3 In the Matter of the ) STIPULATION OF FACTS , 4 Teaching License of ) AND , 5 Charles William Dominiak ) ORDER OF REPRIMAND 1 6 On or about January 21, 2003, the Teacher Standards and Practices Commission I 7 (Commission) received a report from Candace Manary, Superintendent, Jackson County School 8 District, indicating that she received a report from a female student that Charles William 9 Dominiak {Dominiak) had made comments and touched her a manne.r that made her feel 1O uncomfortable. The District held a meeting in the School District Office with Mr. Dominiak to 11 discuss the allegations, and concluded that he was under the influence of alcohol at the 12 meeting. 13 Mr. Dominiak fully cooperated with the Commission's investigation. After review 14 of the matters alleged, Mr. Dominiak and the Commission agree that their respective .5 interests, together with the public interest, are best served by a stipulation to certain 16 facts and the imposition of a Public Reprimand. 17 This Order sets forth the facts upon which the patties have agreed and the sanction to 18 be imposed, Mr. Dominiak stipulates that there are sufficient facts contained in the 19 Commission’s files and records to support the findings of fact and conclusions of law set forth 20 below. In entering into this stipulation, Mr. Dominiak waives the right to a hearing to contest the 21 finding of fact, conclusion of law and order set forth below. . 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission‘ If the Commission does not adopt this Order, neither Mr. Dominiak nor the 24 Commission are bound by these Stipulations and Mr. Dominiak retains all rights to a hearing on 25 the allegations. . ~ O Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND - DOMINIAK 1 STIPULATION 0F FACTS .2 1. The Commission has licensed Mr. Dominiak since July 10, 1972. Mr. Dominiak 3 currently holds a Standard Teaching License valid until January 17, 2008. 4 2. Mr. Dominiak was employed by Jackson County School District No. 6 in Central 5 Point, Oregon from 1982 until retirement on February 1, 2003. 6 3. During the 2002-2003 school year, a female student reported that Mr. Dominiak used 7 humor, gestures, comments, and touching of a sexual nature directed toward students that 8 created an uncomfortable educational environment. 9 4. On December 16, 2002, Mr. Dominiak appeared at a District meeting under 1O the influence of alcohol. 11 5. Mr. Dominiak participated in a six week counseling program at Kolpia counseling 12 services in Ashland, Oregon, from April 8, through May 15, 2003. 13 6. Mr. Dominiak has retired from teaching and moved out of state. He agrees not to .1 apply to renew his Oregon Teaching License. 15 CONCLUSION OF LAW 16 Mr. Dominiak violated OAR 584-020-0040(4)(g) by appearing at a District meeting under 17 the influence of alcohol. This misconduct constitutes Gross Neglect of Duty. The Commission’s 18 authority to impose discipline in this matter is based upon ORS 342.175. 19 iT iS SO STIPULATED: .t * Z?
