5 TINA RENE JOYCE ) AND PROBATION
6 On or about January 26, 2015, the Teacher Standards and Practices Commission
7 (Commission) received information relating to Tina Rene Joyce (Joyce).
8 After review of the matters alleged, Joyce and the Commission agree that their respective
9 interests, together with the public interest, are best served by a stipulation to certain facts, the
10 imposition of a one (1) year suspension of Joyce’s Oregon educator license followed by four (4)
1 1 years’ probation with conditions.
12 This document sets forth the facts upon which the parties have agreed and the stipulated
13 sanction to be imposed. Joyce stipulates that there is sufficient evidence in the Commission‘s
14 files and records to support the findings of fact, conclusions of law, and order set forth below.
15 By signing below, Joyce acknowledges, understands, stipulates, and agrees to the
16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the
17 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
1 8 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final
1 9 Order of Suspension and Probation (Stipulation and Final Order); (ii) this Stipulation and Final
20 Order is a public document and disclosed to the public upon request by the Commission; (iii)
21 this Stipulation and Final Order is contingent upon and subject to approval and adoption by the
22 Commission. If the Commission does not approve and adopt this Stipulation and Final Order,
23 then neither Joyce nor the Commission are bound by the terms herein; (iv) she has fully read
24 this Stipulation and Final Order, and understands it completely; (v) she voluntarily, without any
25 force or duress, enters into this Stipulation and Final Order and consents t0 issuance and entry
26 of the Stipulated Final Order below; (vi) she states that no promises or representation has been
27 made to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an

1 attorney regarding this Stipulation and Final Order and has been fully advised with regard to
2 her rights thereto, or waives any and all rights to consult with an attorney prior t0 entering into
3 this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. In
4 entering into this stipulation, Joyce waives the right to a hearing to contest the findings of fact,
5 conclusions of law and order set forth below.
6 STIPULATION OF FACTS
7 1. The Commission has licensed Tina Rene Joyce since August 15, 2000. J oyce’s current
8 Initial Administrator License, with an endorsement in Administrator (ALL LVL), is valid
9 from November 24, 2014, thru November 23, 2017. During all relevant times Joyce was
1 O employed by the Morrow County School District.
1 1 2. On January 26, 2015, the Commission received a report from the Morrow County School
12 District indicating Joyce may have committed acts which constitute professional
13 misconduct. The Commission received additional complaints from distiict patrons. Two
14 complaints were received on February 5, 2015, one on February 11, 2015, and another on
15 April 20, 2015. These complaints appeared directly or indirectly related to the original
16 school district report of J oyce’s conduct.
17 3. Subsequent investigations indicate Joyce had engaged in an unprofessional relationship
18 with a male, minor-aged student, which included sharing personal information with the
19 student outside the scope of a teacher / student relationship. Joyce had a prior
20 relationship with the student and his family outside of teaching. In the course of J oyce’s
21 duties, she routinely met with the student as he was the Junior Class President and part
22 of student government, which Joyce oversaw. After a student suicide occurred, J oyce’s
23 meetings with the student became more like counseling sessions rather than student
24 government business. Communications between Joyce and the student extended into
25 texting and letter writing. Discussions between Joyce and the student included the topics
26 of being physically abused in the past and discussions of sexuality. 0n January 7, 2015, a

1 school employee found a handwritten letter on the floor near the copy room. It was later
2 determined that this was a letter from Joyce to the student where Joyce shared her
3 personal perspectives related to sex, to include sharing private and intimate information
4 related to Joyce’s sex life with her husband (also a teacher at same school).

1 1 CONCLUSION OF LAW
12 Tina Rene J oyce’s conduct as described above, constitutes gross neglect of duty in
13 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-
14 0010(5) (Use professional judgment); OAR 584-o2o-oo4o(4)(o) as is incorporates OAR 584-
15 020-0035(1)(b)(Refrain from exploiting professional relationships with any student for
16 personal gain, or in support of persons or issues), OAR 584-020-0035(1)(c)(A)(Not
17 demonstrating or expressing professionally inappropriate interest in a student's personal life),
18 OAR 584-020-0035(1)(c)(B) (Not accepting or giving or exchanging romantic or overly
19 personal gifts or notes with a student), and OAR 584-020-0035(1)(c)(D)(Honoring
20 appropriate adult boundaries with students in conduct and conversation at all times).
21 The Commission’s authority to impose discipline in this matter is based upon ORS
22 342.175.
23 ORDER
24 The Commission hereby adopts and incorporates herein the above stipulation of facts,
25 conclusions of law, and based thereon hereby imposes a one (1) year suspension upon Joyce’s
26 Educator License as follows:
27 Tina Rene Joyce’s Educator License is hereby suspended for one (1) year following the
28 adoption 0f this order.

1 Prior to reinstatement, Joyce must provide a favorable evaluation report from a pre-
2 approved provider, meeting commission standards for such evaluations.
3 Prior to reinstatement, the Commission will review the evaluation report mentioned
4 above, and may require Joyce to appear before the Commission to answer any questions of the
5 Commission.
6 Furthermore, the Commission imposes four (4) years of probation upon Joyce to
7 commence upon reinstatement of her license and subject to the following terms and conditions
8 of probation:

1O 1. Joyce shall comply with the Standards for Competent and Ethical Performance of
1 1 Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020.
12 2. Joyce will comply with any recommended counseling, training, or other such
13 requirement (if any) as may be determined/ recommended by the required evaluation
14 report. Joyce will supply written proof of such compliance to the Commission within
15 the first year of her probation period.

18 Violation of any term or condition of probation shall constitute an independent basis for the
19 Commission to revoke J oyce’s educator license or otherwise impose discipline, after first
20 providing Joyce with notice and opportunity for hearing.
