METTEER, JR. ) SUSPENSION OF LICENSE ‘ ) AND PROBATION On or about May 27, 1997, the Teacher Standards and Practices Commission received a report from the Beaverton School District, indicating that Robert E. Metteer, Jr., had been cited to appear in Washington County District Court for Harassment of a high school student. The Executive Director took action to notify Metteer of intent to impose a sanction on his Oregon Substitute Teaching license, and to inform him of his opportunity for hearing. The notice, dated January 27, 1998, and signed by David V. Myton, Executive Director, stated: "You,Robert E. Metteer, Jr., are entitled to a hearing on the proposed action 0f the Commission. If you want a hearing, you must notify the Executive Director of the Commission, in writing, within 21 days of the date of this notice." The notice of opportunity for hearing was sent by U.S. Certified Mail, Return Receipt Requested. FINDINGS 0F FACT l. Robert E. Metteer, Jr. holds an Oregon Substitute Teaching License endorsed in elementary, secondary, physical education and health, issued on October 4, 1995 and valid until March 22, 1999. Metteer was employed as a substitute teacher during the 1996-97 school year in the Beaverton School District. l l , 2. Robert E. Metteer Jr., violated OAR 584-020-0040(4) on or about January 5, 1996, when he called a classroom of middle school children . . a bunch of assholes" and grabbed a 7th grade student by the back of the neck and pushed him. 2. Mr. Metteer violated OAR 584-020-0040(4) on or about January 24, 1997, when he told a class of 4th and 5th grade math students, "Hang in their for five minutes, I've got to take a leak", and "Don't BS me!" 3. Mr. Metteer violated OAR 584-20-040(4)(d) on or about May 21, 12997, when he struck MF (a student) and told MF to, "Get the fuck out of my way." ULTIMATE FINDINGS OF FACT Robert E. Metteer, Jr. violated standards of competent and ethical performance of Oregon on educators by making inappropriate statements to students in Beaverton school district. CONCLUSIONS OF LAW Under OAR 584-020-0040 the Commission is authorized to impose sanctions when educators violate Standards of Competent and Ethical Performance of Oregon Educators. § i V. ' PAGE 1--DEFAULT ORDER~ROBERT E. METTEER, JR. OPINION Mr. Metteer's behavior reflects poor professional judgment and lack of respect for students. The sanctions imposed for his behavior are based upon the belief that he is capable of improved performance and should be entitled to a second chance following a period of suspension of license. ORDER The Commission suspends for one year the Oregon Substitute Teaching License #211674, issued to Robert E. Metteer, Jr. >. On or after March 13, 1999, Mr. Metteer shall be entitled to reinstatement of his Oregon teaching license upon receipt of a complete application. However, he shall be on probation for two years from the date of reinstatement. During this period of probation Metteer shall conduct himself as a law-abiding citizen and shall comply with the Standards of Competent and Ethical Performance of Oregon Educators.
