1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 4 In the Matter of the ) DEFAULT ORDER REVOKING 5 Teaching License of ) RIGHT TO APPLY FOR LICENSURE e MICHAEL DUANE WISDOM ) 7 8 On August 15, 2006, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Michael Duane Wisdom (Wisdom) in which the } 10 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7005 1160 0001 0494 2567 to the address Mr. 12 Wisdom provided to the Commission. The certified mail receipt was signed by Sharon F. 13 Higgins and returned to the Commission on August 28, 2006. The Notice of Opportunity of 14 Hearing, dated August 15, 2006, and signed by Victoria Chamberlain, Executive Director, 15 stated: 16 "You, Michael Duane Wisdom, are entitled to a hearing on the proposed action of the Commission. If you want a hearing, you must file a written request for a , hearing with the Commission within 21 days of the date of this notice. Attached 19 to this notice is a copy of the procedures, right of representation and other rights 20 of parties relating to the conduct of a hearing as required under ORS 21 183.413(2)." 22 23 Mr. Wisdom did not request a hearing. The Commission, therefore, finds 24 Mr. Wisdom to be in default and enters the following findings of fact, conclusions of law 25 and order, based on the tiles and records of the Commission concerning this matter. 26 FINDINGS 0F FACT 27 1. Mr. Wisdom was first licensed by the Commission on May 6, 1998. Mr. Wisdom held 28 a Substitute Teaching License issued February 26, 2002, with a Substitute Any Specialty 29 Endorsement. In 2002, when Mr. Wisdom resigned employment from Echo School District he used ' ‘ the school credit card to charge $5,875.21 for gasoline and other commodities without 3 permission and for personal use. 4 3. On August 30, 2004, Mr. Wisdom was convicted of Theft in the First Degree, ORS 5 164.055 and Fraudulent Use of Credit Card, ORS 165.055 in the Umatilla County Circuit Court 6 State of Oregon. 7 CONCLUSIONS OF LAW 8 Mr. Wisdom’s knowing and substantial unauthorized use of school financial credit for 9 personal purposes constitutes Gross Neglect of Duty as defined in OAR 584-020-0040(4)(a). 10 Mr. Wisdom’s convictions for Theft in the First Degree and Fraudulent Use of Credit Card 11 constitutes Gross Unfitness as defined in OAR 584-020-0040(5)(b) and OAR 584-020- 12 0040(5)(c). The Commission’s authority to impose discipline in this matter under ORS 342.120 13 through 342.430 and OAR Chapter 584. ' DEFAULT ORDER 15 The Commission adopts the above findings of fact and hereby revokes Michael Duane 16 Wisdom‘s right to apply for licensure.
