1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the I 5 Teaching License of I DEFAULT ORDER ' 6 MARK RICHARD GERMAN | SUSPENDING LICENSE 7 | 8 9 On or about September 8, 2000, the Teacher Standards and Practices Commission received a 10 complaint from the Hermiston School District No. 8R, indicating that Mark German had violated 11 his contract by failing to provide 60 days’ written notice prior to resignation. Under OAR 584- 12 050-0020, the Commission informs the educator of intent to suspend the license on the basis of 13 such complaints. The Executive Director took action to notify Mark German of intent to suspend 14 his license, and to inform him of his opportunity for hearing by letter dated October 18, 2000. 15 The letter was sent by Certified Mail—Return Receipt Requested #Z 294 586 819. The receipt 16 was signed by Patty German on October 28, 2000, and returned to TSPC on October 30, 2000. 17 Mark German did not request a hearing. 18 19 FINDINGS OF FACT 20 21 l. On or about May 26, 2000, Mark German signed a contract with the Hermiston School 22 District for the 2000-2001 School year. 23 , ‘24 2. On August l4, 2000, Mark German submitted a letter of resignation and gave the .15 Hermiston School District notice of intent to resign his position as a sixth grade teacher at 26 Armand Larive Middle School. This notification came seven days before he was 27 expected to fulfill his duties. He will also no longer fulfill his basketball and tennis 28 coaching positions. 29 30 3. Meeting in regular session on September 5, 2000, the Hermiston School District Board of 31 Directors took action to seek a suspension of Mark German's Teaching license for the 32 balance of the 2000-01 school year. 33 34 4. The Hermiston School District informed TSPC of this action in a letter dated September 35 6, 2000, requesting the suspension of Mark German's Teaching license. 36 37 38 ULTIMATE FINDINGS OF FACT 39 40 Mark German signed an employment contract with the Hermiston School District on or about 41 May 26, 2000. Mr. German submitted a letter of resignation, dated August l4, 2000, and 42 effective immediately. 43 PAGE l——DEFAULT ORDER-~MARK GERMAN 1 CONCLUSIONS OF LAW i 2 3 ORS 342.553 requires the suspension of a license for the balance of the school year for failure to 4 provide 60 days’ notice prior to resignation. If the charge of the contract violation is proven, and 5 justification for the contract violation is not satisfactory, the Commission is required to suspend 6 the license for the remainder of the school year.
