l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ’ OF THE STATE OF OREGON 2 In the Matter of the 3 Teaching License of STIPULATION AND ORDER 4 ROSEMARY ELLIS PHILLIPS 5 On October l3, 2003, the Teacher Standards and Practices Commission (Commission) 6 issued a Notice of Opportunity for Hearing to Rosemary Ellis Phillips, charging her with a 7 violation of Commission standards. Ms. Phillips requested a hearing on October 20, 2003. 8 After a review of the matters alleged, Ms. Phillips and the Commission have agreed that 9 their respective interests, together With the public interest, are best served by a stipulation to IO certain facts and the imposition of a public reprimand. ll In entering into the stipulation set forth below, Ms. Phillips waives the right to a hearing é to contest the allegations in the notice. This stipulation and order are contingent on approval and adoption by the Commission. If the Commission does not adopt this order, neither Ms. Phillips 14 nor the Commission are bound by any matters contained therein, and Ms. Phillips would retain 15 all rights to a hearing to contest the allegation in the notice. l6 STIPULATION OF FACTS 17 Ms. Phillips and the Commission stipulate as follows: 18 l. Ms. Phillips holds a Substitute Oregon Teaching License that is valid through l9 June l6, 2004. 20 2. On September 24, 1997, the Commission issued a default order suspending Ms. 21 Phillips’ teaching license for failure to submit fingerprints with her application for a teaching 22 license. 23 Page I - STIPULATION AND ORDER MAR- 3 Q 2001? J GM:rdl\GEN15393 y .1 3. The Commission sent a copy of thc suspension order to Ms. Phillips which was 2 received by Ms. Phillips in October 1997. 3 4. Ms. Phillips applied for reinstatement of her substitute teaching license on 4 January 8, 2001, and the Commission reinstated the license on March 7, 2001. 5 5. This failure constitutes a violation of OAR 584-020-0040(4)(c). 17 ORDER 18 Based on the foregoing, the Commission issues a. public reprimand.
