8 On March 11, 2003, the Teacher Standards and Practices Commission (Commission)
9 issued a Notice of Opportunity for Hearing to Sue R. Reedy (Reedy) in which the Commission
10 charged her with misconduct under ORS 342.175. The Notice was sent via U.S. First Class
11 Mail and U.S. Certified Mail, Receipt 7001 0320 0005 0740 5246, to the address Ms. Reedy
12 provided to the Commission. The Certified Mail was returned to the Commission unclaimed on
13 April 4, 2003. The First Class Mail was not returned and is assumed delivered. The Notice of
14 Opportunity of Hearing, dated March 11, 2003, and signed by Victoria Chamberlain, Executive
15 Director, stated:
16 "You, Sue R. Reedy, are entitled to a hearing on the proposed action of the
‘ Commission. If you want a hearing, you must file a written request for a hearing
with the Commission within 21 days of the date of this notice. Attached to this
19 notice is a copy of the procedures, right of representation and other rights of
20 parties relating to the conduct of a hearing as required under ORS 183.413(2)."

22 Ms. Reedy did not request a hearing. The Commission, therefore, finds
23 Ms. Reedy to be in default and enters the following findings of fact, conclusions of law
24 and order, based on the files and records of the Commission concerning this matter.
25 FINDINGS OF FACT
26 1. The Commission has licensed Sue R. Reedy since October 14, 1982. Ms. Reedy
27 currently holds a Standard Teaching License valid July 29, 1999, through August 10, 2004, with
28 Basic Speech Impaired and Handicapped Learner l Endorsements.
29 2. In August of 2001, Ms. Reedy accepted a full-time position as a Speech and
30 Language Therapist for the Greater Albany Public Schools.

1 3. On October 22, 2001, Ms. Reedy reported for duty while under the influence of
Q alcohol. She resigned in lieu of termination on November 8, 2001.
3 4. On October 17, 2001, Ms. Reedy was cited for Trespass in Albany, Oregon. On
4 August 13, 2002, Ms. Reedy entered into a diversion agreement regarding the pending charge
5 in the Municipal Court for the City of Albany, Linn County, Oregon.
6 5. On September 10, 2002, Ms. Reedy was arrested for Driving Under the Influence of
7 lntoxicants in Salem, Oregon.
8 6. On September 23, 2002, Ms. Reedy was arrested for Driving Under the Influence of
9 lntoxicants in Salem, Oregon.
10 7. On May 3, 2003, Ms. Reedy was arrested for Driving Under the Influence of
11 lntoxicants and Driving While Suspended in Salem, Oregon.
12 8. On May 29, 2003, Ms. Reedy was arrested for Driving Under the Influence of
13 lntoxicants and Driving While Suspended in Salem, Oregon.
. CONCLUSIONS 0F LAW
15 Sue R. Reedy violated OAR 584-020-0040(4)(g) by appearing on duty while under the
16 influence of alcohol on October 22, 2001, at the Greater Albany Public Schools. This
17 misconduct constitutes Gross Neglect of Duty. Sue R. Reedy violated OAR 584-020-0040(5)(e)
18 on September 10 and 23, 2002, and May 3 and 29, 2003, by engaging in acts constituting
19 criminal conduct. This misconduct constitutes Gross Unfitness. The Commission's authority to
20 impose discipline in this matter is based upon ORS 342.175.
