'1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 ln the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER AND 5 KENNETH RAY STACY ) ORDER OF REVOCATION 6 On April 22, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from Michael L. Taylor, Superintendent, Parkrose Public Schools indicating 8 that Kenneth Ray Stacy (Stacy), was convicted of a felony crime in the Multnomah County 9 Circuit Court. l 1O Mr. Stacy fully cooperated with the Commissions investigation. After review of the l 11 matters alleged, Mr. Stacy and the Commission agree that their respective interests, together 12 with the public interest, are best served by a stipulation to certain facts and surrender of his 13 teaching license as per OAR 584-050-0027. 14 This Order sets forth the facts upon which the parties have agreed and the sanction to ‘a be imposed. Mr. Stacy stipulates that there are sufficient facts contained in the Commissions 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Stacy waives the right to a hearing to contest the finding of fact, 18 conclusion of law and order set forth below. Mr. Stacy understands that the Commission will 19 revoke his teaching license. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. lfthe Commission does not adopt this Order, neither Mr. Stacy nor the 22 Commission are bound by these Stipulations and Mr. Stacy retains all rights to a hearing on the 23 allegations. 24 STIPULATION OF FACTS 25 1. Mr. Stacy has been licensed by the Commission since July 21, 1989. 26 The Commission issued a Standard Teaching License to Mr. Stacy on November 20, 2000, ./ valid until November 24, 2005. Mr. Stacy was employed by Beaverton School District from 1997 until his resignation 4 in June of 2004. Mr. Stacy's health insurance coverage as an employee of Beaverton School 5 District was terminated by the carrier for filing false insurance claims. 6 4. On August 30, 2004, the Parkrose School District employed Mr. Stacy as an 7 elementary teacher. Parkrose School District terminated Mr. Stacy's employment on May 4, 8 2005. 9 5. On April 18, 2005, Mr. Stacy was convicted of Aggravated Theft 1 (five counts), ORS 1O 164.057 and Forgery 1 (two counts), ORS 165.013, in Multnomah County Circuit Court, 11 Portland, Oregon. The court sentenced Mr. Stacy to five years supervised probation and 12 ordered restitution in the amount of $237,439.30. 3 6. The criminal convictions are related to Mr. Stacys submission of unlawful insurance ‘ claims for payment for services provided to Mr. Stacy's severely disabled daughter. 15 7.
