BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON ~ In the Matter of the ) STIPULATION 0F FACTS Teaching License of ) AND ' KIM SUSAN NOAH ) FINAL ORDER OF REPRIMAND On August 4, 2006, the Teacher Standards and Practices Commission (Commission) received a report from Phyllis Weigel, a patron of the Oregon City School District, indicating that Kim Susan i Noah (Noah) used employment time and school resources for private purposes. ~ Ms. Noah fully cooperated with the Commission's investigation. After review of the matters alleged. Ms. Noah and the Commission agree that their respective interests, together with the public interest, are best sewed by a stipulation to certain facts and a public reprimand. This document sets forth the facts upon which the parties have agreed and the stipulated i sanction to be imposed. Ms. Noah stipulates that there is sufficient evidence in the Commissions . files and records to support the findings of fact, conclusions of Iaw, and order set forth below. ‘ By signing below, Ms. Noah acknowledges, understands, stipulates, and agrees to the } following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of ‘ ‘ fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any i rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand ‘ (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed ‘ to the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by the Commission. This Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Ms. Noah stipulates that there are sufficient facts contained in the Commission's files and records to support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Ms. Noah waives the right to a hearing to contest the findings of fact, conclusion of law and order set forth below. STIPULATION 0F FACTS 1. Ms. Noah has been licensed by the Commission since January 22, 1988. Ms. Noah currently holds an Standard Administrator License valid February 21, 2003, through {I March 22, 2008. 2. Ms. Noah serves as the Principal at West Linn High School, West Linn-Wilsonville School ~ District. ‘ 3. In December, 2005, Ms. Noah opened a jewelry business from her home, know as “What's Hot Now". Initially, the jewelry was displayed in her home. At the suggestion of friends, Ms. Noah , decided to display the jewelry at the district high school. 4. Ms. Noah utilized her district email list serve to announce when and where thejewelry would be displayed at the high school. Displays occurred on four occasions in January, 2006, in the i High School's main office and only during non-class hours. i 5. As soon as Ms. Noah learned of the potential legal ramifications of the displays at school, i she stopped all such activity. "Wises 3i CONCLUSIONS OF LAW Kim Susan Noah's unauthorized use of school computers, employment time and school resources for private purposes is a violation of OAR 584-020-0040(4)(b), as that rule incorporates i OAR 584-020-0035(2)(e). The Commission has the authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR Chapter 584. . FINAL ORDER The Commission adopts and incorporates herein the above finding of facts, conclusions of law, and based thereon, imposes a Public Reprimand on Kim Susan Noah.
