LANNI ) FINAL ORDER OF REPRIMAND 6 On April 12, 2006, the Teacher Standards and Practices Commission (Commission) 7 received information that Anthony P. Lanni (Lanni), Superintendent, North Central Education 8 Service District violated standards by assigning a teacher without proper iicensure. 9 Mr. Lanni fully cooperated with the Commission's investigation. After review of the 1O matters alleged, Mr. Lanni and the Commission agree that their respective interests, together 11 with the public interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the 13 stipulated sanction to be imposed. Mr. Lanni stipulates that there is sufficient evidence in the 4 Commission's files and records to support the findings of fact, conclusions of law, and order set Q forth below. 16 By signing below, Mr. Lanni acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 18 findings of tact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Reprimand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 21 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 22 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 23 Commission does not approve and adopt this Stipulation and Final Order, then neither Mr. Lanni 24 nor the Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 25 Final Order, and understands it completely; (v) he voluntarily, without any force or duress, 6 enters into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Q7 Final Order below; (vi) he states that no promises or representation has been made to induce Page 1 STlPULATlON OF FACTS AND FINAL ORDER OF REPRIMAND - LANNI ‘ him to sign this Stipulation and Final Order; and (vii) he has consulted with an attorney 2 regarding this Stipulation and Final Order and has been fully advised with regard to his rights 3 thereto, or waives any and all rights to consult with an attorney prior to entering into this 4 Stipulation and Final Order and issuance and entry ot the Stipulated Final Order below. 5 STIPULATION OF FACTS 6 1. Mr. Lanni has been licensed by the Commission since May 16, 1995. Mr. Lanni 7 holds a Standard Administrative License issued April 1, 2003, valid through May 12, 2008, with 8 a Standard Superintendent Endorsement. 9 2. Mr, Lanni began employment as Superintendent for North Central Education Service 1O District (ESD) on July 1, 1995. 11 3. On or about January 2, 2004, Mr. Lanni hired and assigned Barry Sears serve as 12 Health Services Instructor in a Professional Technical Program for North Central ESD. Mr. Sears held an initial License with endorsements in Biology and Physics. On May 10, 2004, Mr. it Sears submitted an incomplete application for a Professional Technical Teaching License which 15 the Commission denied. Mr. Sears served as Health Services Instructor for North Central ESD 16 from January 2, 2004 to June 1, 2004. A Professional Technical Teaching License is required 17 by the Commission rules to teach the health services courses that Mr. Sears taught for North 18 Central ESD from January 2, 2004, to June 1, 2004. 19 IT IS SO STIPULATED AND AGREED T0: 20 t 2, l). Lanni assigned Barry Sears in violation of Iicensure requirements. This 3 misconduct constitutes Gross Neglect of Duty in violation of OAR 584-020-0040(4)(i) and OAR 4 584-050-0030(2). The Commission has the authority to impose discipline in this matter under 5 ORS 342.120 through 842.430 and OAR Chapter 584. 6 ORDER 7 The Commission hereby adopts and incorporates herein the above findings of fact, 8 conclusion of law and imposes a Public Reprimand upon the Iicensure of Anthony P.
