KOCH, i 6 7 On or about January 25, 1999, the Teacher Standards and Practices Commission (the 8 “Commission”) issued a Notice of Oppommity for Hearing to John Koch (“Koch”) in which the 9 Commission proposed to suspend or revoke his teaching licenses or otherwise impose discipline 10 under ORS 342.177. The Commission and Koch have now reviewed the matters alleged and 11 agree that their respective interests, together with the public interest, are best served by a 12 stipulation to certain facts and the suspension ofKoch’s teaching license effective April 28 to ( 13 August 15, 1999. This agreement sets forth the facts upon which the parties have agreed and the . i 14 sanctions to be imposed. In entering into this Stipulation, Koch waives his right to a hearing to i 15 contest any of the findings set forth below or to contest the Commis sion’s Order. 16 FINDINGS OF FACT 17 1. Koch was employed as a high school teacher by the Estacada School District during the 18 1997-98 school year. l9 2v During the 1997-98 school year, Koch failed to demonstrate personal integrity when he 20 used school resources and facilities during school time to recruit students for an independent, 21 non-school sponsored tour in Europe. 22 3. | Between July 1 and 15, 1999, while acting as Group Leader for the Educational 23 Foundation Tours in Europe, Koch failed to demonstrate personal integrity when he consumed 24 alcohol with current Estacada Egh School students and smoked marijuana in the presence of M.- JL 25 recent graduateil of the school. i 26 /// . Koch resigned his teaching position at 2 Estacada High School on August 28, 1998. He fiirther agrees to a suspension of his teaching 3 license. 4 5 Koch voluntarily enters into this Stipulation of Facts with knowledge that the 6 Commission will suspend his teaching license from April 28 to August 15, 1999. 4 7 This Stipulation is contingent upon approval and adoption of the Order by the 8 Commission.
