8 On August 15, 2006, the Teacher Standards and Practices Commission (Commission)

9 issued a Notice of Opportunity for Hearing to German Corona-Ruiz (Corona-Ruiz) in which the

. 10 Commission charged him with misconduct under ORS 342.175. The Notice was sent via U.S.
11 First Class Mail and U.S. Certified Mail Receipt 7005 1160 0001 0494 2550 to the address
12 Mr. Corona-Ruiz provided to the Commission, together with a copy to Ralph Wiser, Attorney at
13 Law. The certified mail receipt was signed by Fabiola Camon and returned to the Commission
14 on September 18, 2006. The Notice of Opportunity of Hearing, dated August 15, 2006, and
15 signed by Victoria Chamberlain, Executive Director, stated:
16 "You, German Corona-Ruiz, are entitled to a hearing on the proposed action of
the Commission. If you want a hearing, you must file a written request for a
hearing with the Commission within 21 days of the date of this notice. Attached

19 to this notice is a copy of the procedures, right of representation and other rights
20 of parties relating to the conduct of a hearing as required under ORS
21 183.413(2)."

23 The Commission, therefore, finds Mr. Corona-Ruiz to be in default and enters the

, 24 following findings of fact, conclusions of law and order, based on the files and records of
25 the Commission concerning this matter.
26 FINDINGS 0F FACT
27 1. Mr. Corona-Ruiz has been licensed by the Commission since August 23, 2000. The
28 Commission issued an Initial Teaching License to Mr. Corona-Ruiz on May 20, 2004, valid until
29 January 11, 2008, with a Spanish Endorsement.
30 2. Between August 21, 2000, and December 16, 2005, while teaching for Ontario
31 School District, Mr. Corona-Ruiz made sexual comments to students and had sexual contact

1 3. Between August 21, 2000, and December 16, 2005, while teaching for Ontario
_ a School District, Mr. Corona-Ruiz made unwanted sexual comments to students.
3 4. Mr. Corona-Ruiz failed to respond to the Commissions requests for information, to
4 furnish documents and to participate in interviews.
5 CONCLUSIONS OF LAW
3 German Corona-Ruiz’s unwanted sexual comments and sexual contact with students
8 while teaching at Ontario School District between August 21, 2000, and December 16, 2005, is
9 in violation of OAR 584-020-0040(4)(f) and OAR 584-020-0040(4)(|). Mr. Corona-Ruiz’ failure to
10 respond to the Commission's requests for information, to furnish documents or to participate in
11 interviews is in violation of OAR 584-020-0040(4)(p). This misconduct constitutes Gross
12 Neglect of Duty. The Commission has the authority to impose discipline in this matter under
13 ORS 342.120 through 342.430 and OAR Chapter 584.
' 14 DEFAULT ORDER
. The Commission adopts and incorporates herein the above findings of facts and
16 conclusions of law, and based thereon, hereby revokes the Initial Teaching License issued to
17 German Corona-Ruiz.
