. 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License 0f ) ORDER OF SUSPENSION 5 CHRISTOPHER KEVIN CAMPBELL ) AND PROBATION 6 DOB/051175 ) 7 8 On or about February 27, 2001, the Teacher Standards and Practices Commission 9 (Commission) received a report from Jack Stoops, Superintendent, Lincoln County School 10 District, alleging that Christopher Kevin Campbell violated Sexual Harassment Policy and 11 misused his school computer to access sexually explicit material over the internet. 12 On or about April 9, 2001, the Commission notified Christopher Kevin Campbell of that 13 report, provided him a copy of that report and invited his response. 14 Mr. Campbell fully cooperated with the Commission’s investigation. After review of the .15 matters alleged, Mr. Campbell and the Commission agree that their respective interests, 16 together with the public interest, are best served by a stipulation to certain facts and the 17 imposition of a ninety (90) day suspension, followed by a period of probation of two (2) years. 18 This Order sets forth the facts upon which the parties have agreed and the sanction to 19 be imposed. In entering into this stipulation, Mr. Campbell waives the right to a hearing to 20 contest the finding of fact, conclusion of law and order set forth below. Mr. Campbell 21 understands that the probation will be subject to specific conditions. 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission. If the Commission does not adopt this Order, neither Mr. Campbell nor the 24 Commission are bound by these Stipulations and Mr. Campbell retains all rights to a hearing on 25 the allegations. 26 STIPULATION OF FACTS .27 1. Mr. Campbell holds a Transitional Teaching License with Chemistry and Biology 28 Endorsements valid July 14, 2000 through July 14, 2003. He also holds a Restricted (to Lincoln Page 1 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION Q . 1 County School District) Transitional Teaching License with an Integrated Science Endorsement. 2 valid November 27, 2000 through July 14, 2003. 3 2. Mr. Campbell was employed by the Lincoln County School District as a teacher at 4 Taft High School beginning in September 2000, until resignation in lieu of termination February 5 26, 2001. 6 3. A District-owned computer with Internet access was present in Mr. Campbell’s 7 classroom for his use in connection with his assigned responsibilities. 8 4. The District has a clearly defined, acceptable use policy. The District's policy prohibits 9 the use or attempted use of equipment for Internet access of sexually explicit materials. 10 5. Mr. Campbell used his classroom computer on multiple occasions to access sexually 11 explicit materials through the District's Internet connection in violation of District policy regarding 12 Internet use during student contact hours and non-student contact hours. '13 6. Mr. Campbell engaged in inappropriate unprofessional communication with students. 14 He admits that some of these remarks may have been overly personal and may have made 15 some student feel uncomfortable 16 7. Mr. Campbell admits that he should not have used the District computer for viewing 17 sexually explicit materials or made inappropriate comments to students and has expressed 18 remorse for doing so. 19 ULTIMATE FINDING OF FACT 20 Christopher Campbell used the computer equipment owned by his employer, Lincoln 21 County School District, located on school premises, to access sexually explicit materials from 22 September 2000 until January 2001. Mr. Campbell was fully aware that accessing such 23 materials at the workplace with a District owned computer was inappropriate and against District 24 policy. Mr. Campbell failed to demonstrate a commitment to use professional judgment when .25 he made inappropriate and unprofessional comments to students. Myton Executive Director Date 11 Teacher Standards and Practices Commission 12 ORDER 13 The Oregon Transitional Teaching License and the Restricted Transitional Teaching 14 License of Christopher Campbell are suspended for a period of ninety (90) days beginning on 15 July 1, 2001. At the end of this suspension period, Mr. Campbell's Transitional Teaching '16 License will be reinstated upon: 17 1. Submission of a complete application and fees; 18 2. Submission of documentation that he has undergone an evaluation by a 19 psychotherapist or medical professional acceptable to the Commission, and the evaluator 20 submits a written report to the Commission attesting (a) Mr. Campbell is fit to work with children 21 and teenagers, and (b) there is a high probability he will not use school district equipment to 22 access sexually explicit materials or engage in similar inappropriate behavior. Any costs 23 associated with the assessment or treatment will be the responsibility of Mr. Campbell. 24 3. Submission of documentation that he has completed (at his own expense), an 25 intensive education program regarding appropriate boundaries with students including gender 26 equity education and sexual harassment conducted by a qualified trainer approved in advance ‘ 27 by the Commission. This intensive training shall consist of, at least, five (5) one and one-half I O Page 3 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION ' 1 (1 1/z) hour sessions. Mr. Campbell will provide the trainer with a copy of this Order. The 2 program trainer will provide the Commission with a report of successful program completion. 3 Upon the reinstatement of his teaching license, Mr. Campbell shall be placed on 4 probation by the Commission for a period of two (2) years subject to the following conditions: 5 1. Mr. Campbell shall substantially comply with any treatment or counseling as 6 recommended by the individual who completed the evaluation described above. Mr. Campbell 7 shall authorize and sign any consent forms as necessary for the treatment provider or counselor 8 to furnish records to or discuss Mr. Campbell's treatment with the Commission. 9 2. Mr. Campbell shall comply with all Standards for Competent and Ethical Performance 1O under Chapter OAR 584, Division 020. 11 3.
