1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION V 2 OF THE STATE OF OREGON 3 ln the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER 5 SHANNON LEIGH WILSON ) OF SUSPENSION 6 On May 22, 2008, the Teacher Standards and Practices Commission (Commission) 7 received a report from Ron Naso, Superintendent, North Clackamas School District indicating 8 that Shannon Leigh Wilson (Wilson) reported to duty under the influence of alcohol. 9 Wilson fully cooperated with the Commissions investigation in this matter. After review 10 of the matters alleged, Wilson and the Commission agree that their respective interests, 11 together with the public interest, are best sewed by a stipulation to certain facts and the \ 12 imposition of a thirty (30) day suspension. 1S This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Wilson stipulates that there is sufficient evidence in the 15 Commission’s files and records to support the findings of fact, conclusions of law, and order set 16 forth below. 17 By signing below, Wilson acknowledges, understands, stipulates, and agrees to the 18 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 19 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 20 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 21 Order of Suspension (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public 22 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and 23 Final Order is contingent upon and subject to approval and adoption by the Commission. If the 24 Commission does not approve and adopt this Stipulation and Final Order, then neither Wilson 25 nor the Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 26 Final Order, and understands it completely; (v) she voluntarily, without any force or duress, 27 enters into this Stipulation and Final Order and consents toissuance and entry of the Stipulated Page 1 - STIPULATION OF FACTS AND FINAL ORDER OF SUSPENSION - WILSON 1 Final Order below; (vi) she states that no promises or representation has been made to induce 2 her to sign this Stipulation and Final Order; and (vii) she has consulted with an attorney 3 regarding this Stipulation and Final Order and has been fully advised with regard to her rights 4 thereto, or waives any and all rights to consult with an attorney prior to entering into this 5 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. Wilson 6 understands that the probation will be subject to specific terms and conditions. > 7 STIPULATION OF FACTS 8 1. The Commission has licensed Wilson since July 28, 2000. Wilson currently holds an 9 Initial l Teaching License valid June 27, 2007, through December 8, 2010, with an endorsement 10 in Special Education. 11 2. Ms. Wilson was employed by the North Clackamas School District as a learning 12 specialist until her resignation June 12, 2008. 13 3. On April 28, 2008, Wilson was suspected of being under the influence of intoxicants 14 and asked to submit to a breathalyzer test. Between 11:41 a.m. and 11:58 a.m., Wilson took 15 two breathalyzer tests, resulting in blood alcohol readings of 0.1 12 and 0.116. 16 4. On May 14, 2008, Wilson was suspected of being under the influence of intoxicants 17 and asked to submit to a breathalyzer. Between 11:50 am and 12:07 p.m., Wilson took two 18 breathalyzer tests, resulting in blood alcohol readings of 0.027 and 0.023. 19 5. Wilson submitted documentation to the Commission that she had voluntarily 20 undergone an alcohol evaluation by a licensed counselor and voluntarily engaged in and 21 successfully completed alcohol counseling. Wilson also submitted evidence that she had been 22 taking medication that could have affected her blood-alcohol level. 23 6. This conduct constitutes gross neglect of duty in 8 violation of OAR 584-020-0040(4)(g) and OAR 584-020-0040(4)(k). The Commission has the 9 authority to impose discipline in this matter under ORS 342.120 through 342.430 and OAR 10 Chapter 584. 1 1 FINAL ORDER 12 The Commission hereby adopts and incorporates herein the above findings of fact, 13 conclusions of law, and based thereon hereby imposes a thirty (30) day suspension upon 14 Wilson.
