1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER AND 5 MARK ALFRED ALVARADO ) ORDER OF REVOCATION 6 On or about June 22, 2004, the Teacher Standards and Practices Commission 7 (Commission) received a report from Ed Schumacher, Superintendent, Union-Baker School 8 District, indicating that Mark Alvarado admitted to making inappropriate comments in the 9 workplace, while denying the alleged touching of female workers. 10 Mr. Alvarado has fully cooperated with the TSPC investigation. After review of the 11 matters alleged, Mr. Alvarado and the Commission agree that their respective interests, 12 together with the public interest, are best served by a stipulation to certain facts and a surrender 13 of his teaching license pursuant to OAR 584-020-0027. 14 This Order sets forth the facts upon which the parties have stipulated and the sanction to 15 be imposed. Mr. Alvarado stipulates that there are sufficient facts contained in the 16 Commissions files and records to support the findings of fact and conclusions of law set forth 17 below. In entering into this stipulation, Mr. Alvarado waives the right to a hearing to contest the 18 findings of fact, conclusions of law and Order set forth below. Mr. Alvarado understands that 19 upon surrender the Commission will revoke his teaching license. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Alvarado nor the 22 Commission are bound by these stipulations and Mr. Alvarado retains all rights to a hearing on 23 the allegations. 24 STIPULATION OF FACTS 25 1. Mr. Alvarado holds a Five-Year Professional Technical License with an Endorsement 26 in Engineering Technology, issued January 2, 2004, valid through August 8, 2008. Mr. Alvarado served as an Alternative Education Instructor with the Nyssa 3 Alternative Education Program. 4 3. On April 19, 2004 the District completed an investigation of sexual harassment claims 5 from female employees working at Nyssa Educational facility. Mr. Alvarado was named in this 6 investigation and he admits to making inappropriate comments in the workplace. Mr. Alvarado 7 denies the alleged touching of female workers. 8 4. This conduct constitutes Gross Neglect of Duty in 20 violation of OAR 584-020-0040(4)(l).
