1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND _ 5 ELIZABETH SCHILLINGER ) FINAL ORDER OF REPRIMAND 6 On June 27, 2006, the Teacher Standards and Practices Commission (Commission) received 7 a report from Kathryn Baker, Superintendent, Salem-Keizer School District, indicating that Elizabeth 8 Schillinger (Schillinger) showed R-rated film clips to 4‘h and 5th grade students. 9 Ms. Schillinger fully cooperated with the Commission's investigation. After review of the 10 matters alleged, Ms. Schillinger and the Commission agree that their respective interests, together 11 with the public interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the stipulated 13 sanction to be imposed. Ms. Schillinger stipulates that there is sufficient evidence in the 14 Commission’s files and records to support the findings of fact, conclusions of law, and order set forth 15 below. 16 By signing below, Ms. Schillinger acknowledges, understands, stipulates, and agrees to the 17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of 18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 19 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand 20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 21 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon 22 and subject to approval and adoption by the Commission. If the Commission does not approve and 23 adopt this Stipulation and Final Order, then neither Ms. Schillinger nor the Commission are bound by 24 the terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it 25 completely; (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order 26 and consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no 27 promises or representation has been made to induce her to sign this Stipulation and Final Order; and 28 (vii) she has consulted with an attorney regarding this Stipulation and Final Order and has been fully Page 1 - STIPULATION OF FACTS AND FINAL ORDER 0F REPRIMAND - SCHILLINGER 1 advised with regard to her rights thereto, or waives any and all rights to consult with an attorney prior 2 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order 3 below. This Order sets forth the facts upon which the parties have agreed and the sanction to be 4 imposed. Ms. Schillinger stipulates that there are sufficient facts contained in the Commission's files 5 and records to support the findings of fact and conclusions of law set forth below. In entering into this 6 stipulation, Ms. Schillinger waives the right to a hearing to contest the findings of fact, conclusion of 7 law and order set forth below. 8 STIPULATION 0F FACTS 9 1. 'Ms. Schillinger has been licensed by the Commission since November 23, 2002. 10 Ms. Schillinger currently holds an Initial Teaching License with a Multiple Subjects Self-Contained 11 endorsement for early childhood and elementary grade authorizations and with a Multiple Subjects 12 endorsement for middle-level grade authorization issued by the Commission on November 10, 2005. 13 The license expires November 9, 2009. 14 2. Ms. Schillinger showed clips of the R-rated Movie, “The Life Aquatic” to 41h and 5"1 grade 15 students in an effort to illustrate the difference between a faux and real documentary. 16 3. The movie clips in question contained nudity (which Ms. Schillinger blocked with her hand) 17 and profanity. 18 4. Ms. Schillinger forewarned her 5"‘ grade class of the profanity in the clip and asked the 19 students not to tell their parents about the movie. Ms. Schillinger did not provide a warning to her 4‘h 20 grade students. 21 5. This conduct 3 constitutes gross neglect of duty in violation of OAR 584-020-0040(4)(n) as it incorporates OAR 584- 4 020-0010(5). The Commission has the authority to impose discipline in this matter under ORS 5 342.120 through 342.430 and OAR Chapter 584. 6 FINAL ORDER 7 The Commission adopts and incorporates herein the above finding of facts, conclusions of 8 Iaw, and based thereon, imposes a Public Reprimand on Elizabeth Schillinger.
