1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION Q OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) FINAL ORDER OF REPRIMAND 5 CINDIE MARIE CORRIE ) AND PROBATION 6 On May 3, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a complaint from Michael J. Keizer, Coordinator of K-12 Special Programs, Douglas 8 Education Service District, alleging that Cindie Marie Corrie (Corrie), while counseling a female 9 student solicited the unborn child of that student. 1O Ms. Corrie fully cooperated with the Commission’s investigation. After review of the 11 matters alleged, Ms. Corrie and the Commission agree that their respective interests, together 12 with the public interest, are best served by a stipulation to certain facts, the imposition of a 13 public reprimand followed by a three (3) year probation. 4 This document sets forth the facts upon which the parties have agreed and the Q stipulated sanction to be imposed. Ms. Corrie stipulates that there is sufficient evidence in the 16 Commission's files and records to support the findings of fact, conclusions of law, and order set 1 17 forth below. 18 By signing below, Ms. Corrie acknowledges, understands, stipulates, and agrees to the 19 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 20 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 21 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Final Order 22 of Reprimand and Probation (Stipulation and Final Order); (ii) this Stipulation and Final Order is 23 a public document and disclosed to the public upon request by the Commission; (iii) this 24 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 25 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 6 then neither Ms. Corrie nor the Commission are bound by the terms herein; (iv) she has fully ‘ read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, without Page 1 - STIPULATION OF FACTS, FINAL ORDER OF REPRIMAND AND PROBATION - CORRIE 1 any force or duress, enters into this Stipulation and Final Order and consents to issuance and Q entry of the Stipulated Final Order below; (vi) She states that no promises or representation has 3 been made to induce her to sign this Stipulation and Final Order; and (vii) she has consulted 4 with an attorney regarding this Stipulation and Final Order and has been fully advised with 5 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to 6 entering into this Stipulation and Final Order and issuance and entry of the Stipulated Final 7 Order below. This Order sets forth the facts upon which the parties have agreed and the 8 sanction to be imposed. Ms. Corrie stipulates that there are sufficient facts contained in the 9 Commission's files and records to support the findings of fact and conclusions of law set forth 10 below. In entering into this stipulation, Ms. Corrie waives the right to a hearing to contest the 11 findings of fact, conclusion of law and order set forth below. Ms. Corrie understands that the 12 probation will be subject to specific terms and conditions. 3 STIPULATION OF FACTS ‘ 1. Ms. Corrie has been licensed by the Commission since August 28, 2002. 15 Ms. Corrie currently holds a Limited Student Services License valid April 27, 2006, through ‘ 16 January 22, 2010, with a Student Service Specialist endorsement. E 17 2. Ms. Corrie began her assignment as a Behavior Consultant for Douglas Education 18 Service District on August 28, 2002. Ms. Corrie's employment was terminated effective 19 March 17, 2006. 20 3. 0n or about January 18, 2006, while working at Douglas High School, in her duties 21 as a Behavior Consultant for Douglas ESD, Ms. Corrie solicited in writing the unborn baby of a 22 9"‘ grade child she was counseling. 23 Ms. Corrie enters into this Stipulation of Facts with the knowledge that in addition to the 24 public reprimand the Commission will place her on probation for a period of three (3) years. ‘5 This Stipulation is contingent upon approval and adoption of the Order by the full Commission. Page 2 _ STIPULATION OF FACTS, FINAL ORDER 0F REPRIMAND AND PROBATION - CORRIE 1 If the Commission does not adopt this Order, neither Ms. Corrie nor the Commission are bound Q by these stipulations and Ms. Corrie retains the right to a hearing on the allegations. 3 IT IS SO STIPULATED AND AGREED TO: 4 [my ' wag 41m. $49101 5 Cindie Marie Corrie Date 9W” 3W; 8 Victoria C - -' 3515', Exective Director Date 9 Teacher Standards and Practices Commission 1O CONCLUSIONS OF LAW 11 Cindie Marie Corrie violated OAR 584-020-0040(4)(o) substantial deviation from 12 professional standards as set forth in OAR 584-020-0035(1)(b) refrain from exploiting 13 professional relationships with any student for personal gain...when she solicited the unborn 14 child of a student she was counseling on pregnancy issues. This conduct constitutes Gross 5 Neglect of Duty. The Commission has authority to impose discipline in this matter under ORS Q 342.120 through 342.430 and OAR Chapter 584. 17 FINAL ORDER 18 The Commission adopts and incorporates herein the above finding of facts, conclusions 19 of law, and based thereon, hereby imposes a Public Reprimand on Cindie Marie Corrie. This 20 Order shall serve as the Public Reprimand. 21 Furthermore, the Commission places Ms. Corrie on Probation for a period of three (3) 22 years from the date of this order subject to the following terms and conditions of probation: 23 1. During the period of her probation, Ms. Corrie shall submit to the Executive Director 24 of the Commission reports of her continued counseling. Ms. Corrie shall provide these reports 25 every six (6) months during her probation, on or before September 15, 2007; March 15, 2008; 26 September 15, 2008; March 15, 2009, September 15, 2009, and March 15, 2010; 7 2. Ms. Corrie shall comply with the Standards for Competent and Ethical Performance é of Oregon Educators under Oregon Administrative Rules, Chapter 584, Division 020.
