8 On February 25, 2003, the Teacher Standards and Practices Commission issued a
9 Notice of Opportunity for Hearing to Douglas Hastings, in which the Commission proposed to
10 deny issuance of a license under ORS 342.143 and its administrative rules implementing that
11 legal authority OAR 584-050-0006(2). The Notice was sent via U.S. First Class Mail and U.S.
12 Certified Mail Receipt #7001 0320 0005 0740 5130 to the address Mr. Hastings provided to
13 the Commission. The certified mail receipt was signed by Douglas Hastings and returned to
14 the Commission on February 28, 2003. Douglas Hastings responded via letter dated March 1,
15 2003, stating he does not have the time to undertake a formal hearing or an appeal and
‘ requested a waiver provision be applied to his situation. Victoria Chamberlain responded on
17 March 20, 2003, stating his request to waive administrative rules cannot be granted.
18 The Notice of Opportunity for Hearing, signed by Victoria Chamberlain, Executive
19 Director, stated: .
20 If a request for hearing is not received within this 21-day period, your right to
21 hearing shall be considered waived unless your failure to request a hearing was
22 beyond your reasonable control. If you do not request a hearing or if you fail to
23 appear at a hearing, the Commission will uphold the denial of your application for
24 an Oregon teaching license.

26 Based on the foregoing, the Commission finds Douglas Reynolds Hastings in default
27 and such default is hereby entered. Based on the records and files of the Commission, the
28 Commission enters the following findings of fact, conclusions of law and order.

1 FINDINGS OF FACT
Q 1. On or about February 4, 2003, TSPC received an Application for Educator License
3 Form C-1 signed by Douglas Hastings along with additional documentation to apply for a
4 Restricted Substitute Teaching License at the High School Level.
5 2. In June 1993, Mr. Hastings obtained a Doctor of Jurisprudence degree from the g
6 Santa Barbara College of Law, California. The Santa Barbara College of Law is not a regionally
7 accredited institution with the Western Association of Schools and Colleges. Part of the
8 necessary requirements for a Restricted Substitute Teaching License is a bachelor's degree or
9 higher from a regionally accredited institution or the approved foreign equivalent of such degree
10 related to teaching at one or more levels. g
11 CONCLUSIONS OF LAW
12 To be eligible for a Restricted Substitute Teaching License, Mr. Hastings must have a
13 bachelor's degree or higher from a regionally accredited institution or the approved foreign
'1 equivalent of such degree related to teaching at one or more levels in one or more specialties.
15 Therefore, Mr. Hastings has not satisfied the academic or education requirements established
16 by OAR 584-060-0181 for a Substitute Teaching License.
17 ORDER
18 The Commission denies issuance of Iicensure to Douglas Reynolds Hastings.
