9 On June 14, 2006, the Teacher Standards and Practices Commission (Commission)
10 issued a Notice of Opportunity for Hearing to Matthew Allen Perry (Perry) in which the
11 Commission charged him with conviction of a crime listed in ORS 342.143(3). The Notice was
12 sent via U.S. First Class Mail and U.S. Certified Mail Receipt #7005 1160 0001 0494 2536 to
13 the address Mr. Perry provided to the Commission. The U.S. Certified Mailing receipt was
14 signed by Mr. Perry and returned to the Commission on June 19, 2006. The Notice of
15 Opportunity of Hearing, dated June 14, 2006, and signed by Victoria Chamberlain, Executive
16 Director, stated:
Q "You, Matthew Allen Perry, are entitled to a hearing on the proposed action of the
Commission. If you want a hearing, you must file a written request for a hearing
19 with the Commission within 21 days of the date of this notice. Attached to this
20 notice is a copy of the procedures, right of representation and other rights of
21 parties relating to the conduct of a hearing as required under ORS 183.413(2).”

23 Mr. Perry did not request a hearing. The Commission, therefore, finds
24 Mr. Perry to be in default and enters the following findings of fact, conclusions of law and
25 order, based on the files and records of the Commission concerning this matter.
26 FINDINGS 0F FACT
27 1. Mr. Perry has been licensed by the Commission since September 9, 2003.
28 Mr. Perry currently holds a Restricted Transitional Teaching License issued May 16, 2005, valid
29 until September 9, 2006, with a Basic Mathematics endorsement, and a Transitional Teaching
30 License issued September 9, 2003, valid until September 9, 2006, with a Social Studies
31 endorsement.

‘ 2. Mr. Perry began employment with Nyssa School District as a licensed teacher in
2 August of 2003. On December 19, 2005, Mr. Perry was placed on administrative leave.
3 3. On May 15, 2006, Mr. Perry was convicted of Sexual Abuse in the Second Degree,
4 ORS 163.425, in the Circuit Court of the State of Oregon for Malheur County. Mr. Perry was
5 sentenced to 90 days in jail, fined $2,673 and placed on supervised probation for a period of 36
6 months.
7 CONCLUSIONS OF LAW
8 Matthew Allen Perry's conviction of Sexual Abuse in the Second Degree, ORS 163.425,
9 is listed in ORS 342.143(3). The Commission is required to revoke the Restricted Transitional
10 Teaching License and Transitional Teaching License issued to Mr. Perry and revoke his right to
11 apply for a license pursuant to ORS 342.175(2). The Commission has the authority to impose
12 discipline 1n this matter under ORS 342.120 through 342.430 and OAR Chapter 584.
3 FINAL ORDER
Q The Commission adopts and incorporates herein the above findings of fact and
15 conclusion 0t law, and based thereon, hereby revokes the Restricted Transitional Teaching
l6 License and Transitional Teaching License issued to Matthew Allen Perry and revokes his right
17 to apply for a teaching license.
