1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 a . 3 OF THE STATE OF OREGON l 4 5 6 7 In the Matter of the ) 8 Teaching License of: ) DEFAULT ORDER 9 ) SUSPENDIN G LICENSE 10 SUSAN BETH RAMIREZ ) 11 ) l2 13 14 On or about September 29, 2006, the Teacher Standards and Practices 15 Commission received a report from the Tigard-Tualatin School District 23]., indicating 16 that Susan Ramirez had violated her contract by failing to provide 60 days’ written notice 17 prior to resignation. The district did not include the documentation as required under 18 OAR 584-050-0020. Subsequently, the district submitted the documentation on October l9 l7, 2006. Under OAR 584-050-0020, the Commission informed the educator of intent to 20 suspend the license on the basis of such report. The Executive Director took action to 21 notify Susan Ramirez of intent to suspend her license, and t0 inform her of her 22 opportunity for hearing by letter dated December l, 2006. The letter was sent by 23 Certified Mail—Return Receipt Requested #7005 1160 0001 0494 2727. The receipt was ' 24 signed by Dan Ramirez on December 2, 2006, and returned to TSPC. Susan Ramirez did 25 not request a hearing. 26 27 Susan Ramirez did not request a hearing within the time required by the notice. Based on 28 the foregoing, the Commission finds Susan Ramirez to be in default and enters the 29 following findings of fact, conclusion of law and order based on the Commission’s files 30 and records. 31 32 FINDINGS OF FACT 33 34 l. Susan Ramirez was employed as a teacher for the Tigard-Tualatin School 35 District during the 2004-2005 and 2005-2006 school years. 36 37 2. Susan Ramirez resigned from her teaching position in violation of her 38 employment contract without first providing 60 days’ prior notice to the district. On 39 September l, 2006, Susan Ramirez submitted a letter of resignation to the Director of 40 Human Resources in Tigard-Tualatin School District. 41 42 3, Meeting in regular session on September 19, 2006, the Tigard-Tualatin 43 School District Board took action to seek a suspension of Susan Ramirez’s teaching 44 license for the balance of the 2006-07 school year. 45 Page l — FINAL ORDER—Susan Ramirez 1 4. The Tigard-Tualatin School District informed TSPC of this action in a ' 2 letter dated September 25, 2006, and October l7, 2006, requesting the suspension of 3 Susan Rarnirez’s teaching license. 4 5 5.
