1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS, 5 GEORGE EDWARD GADBURY ) SURRENDER, AND 6 ) ORDER OF REVOCATION I g On or about January 31, 2002, the Teacher Standards and Practices l 9 Commission (Commission) received a report from Maureen Sloane, Human Resources 1O Counsel, Portland Public Schools, indicating that George Edward Gadbury made 11 inappropriate sexual advances to a student at Cleveland High School during the 2001- 12 2002 academic year. 13 After review of the matters alleged, Mr. Gadbury and the Commission agree ‘ 14 that their respective interests, togetherwith the public interest, are best served by a 1 15 stipulation to certain facts and surrender of his teaching license as per OAR 584-050- 16 0027. 17 This Order sets forth the facts upon which the parties have agreed and the 18 sanction to be imposed. In entering into this stipulation, Mr. Gadbury waives the right to 19 a hearing to contest the finding of fact, conclusion of law and order set forth below. Mr. 20 Gadbury understands that the Commission will revoke his teaching license. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Gadbury nor the 23 Commission are bound by these Stipulations and Mr. Gadbury retains all rights to a 24 hearing on the allegations. ‘ 25 /// Page 1 STIPULATION OF FACTS, SURRENDER, AND ORDER OF REVOCATION - GADBURY . 1 STIPULATION OF FACTS 2 1. Mr. Gadbury has been licensed by the Commission since September 20, 3 1989. The Commission issued Mr. Gadbury’s current Standard Teaching License on 4 January 5, 2000 valid until January 9, 2005, with Standard Physical Education and 5 Basic Advanced Mathematics Endorsements. - 6 2. Mr. Gadbury was employed by the Portland Public Schools as a teacher at 7 Cleveland High School beginning in September of 1990. On or about January 14, 8 2002, a student reported that Mr. Gadbury said things to her that caused her to be 9 fearful and upset, affected her ability to function at school. Mr. Gadbury resigned his 10 teaching position on February 15, 2002. There were no prior complaints in his 11 personnel file. '12 3. Mr. Gadbury wrote a note to a female high school student asking, ‘Will you 13 sleep with rne tonight? Smile if yes." 14 4. Mr. Gadbury told the same female student that her breasts were large and 15 asked her if they were real. 16 5. Mr. Gadbury informed the same female student that he had an erection. 17 6. This 5 misconduct constitutes Gross Neglect of Duty.
