1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the | 5 Teaching License of | DEFAULT ORDER 6 RANDALL WAYNE WALLIN I SUSPENDING LICENSE 7 l 8 9 On or about October 23, 2001, the Teacher Standards and Practices Commission received a 10 complaint from Bill Burnett, Superintendent of South Umpqua School District #19, indicating 11 that Randall Wallin had violated his contract by failing to provide 60 days’ written notice prior to ‘ 12 resignation. The district did not include a copy of Mr. Wallin’s contract and the school board’s 13 resolution to suspend his license as required under OAR 584-050-0020. Subsequently, the 14 district submitted the resolution and contract on December 21, 2001 , and the Commission 15 notified Mr. Wallin of intent to suspend his teaching license, and his opportunity for hearing by 16 letter dated January 28, 2002. The letter was sent by Certified Mail—Return Receipt Requested 17 #7001 0320 0005 0740 9497. The receipt was signed by Randall W. Wallin on February 2, ‘ 18 2002, and returned to TSPC on February 5, 2002. l9 20 Mr. Wallin did not request a hearing within the time required by the notice. Based on the 21 foregoing, the Commission finds Mr. Wallin to be in default and enters the following findings of 22 fact, conclusion of law and order based on the Commission’s files and records. 23 24 FINDINGS OF FACT 25 26 1. On or about July 12, 2001, Randall W. Wallin signed a contract with the South Umpqua 27 District l9 for the 2001-2002 school year. 28 29 2. On October 16, 2001, Randall Wallin submitted a letter of resignation effective upon 30 receipt from his position as teacher at South Umpqua High School. The principal of 31 South Umpqua High School contacted Mr. Wallin and asked him to reconsider his 32 resignation and stay until a replacement could be found. Mr. Wallin was unwilling to do 33 SO‘ 34 35 3. Meeting in regular session on November l4, 2001, the South Umpqua School Board took 36 .. action to seek a suspension of Randall Wallin’s teaching license for the balance of the 37 2001-02 school year. 38 . 39 4. The South Umpqua School District informed TSPC of this action in a letter dated 40 October 19, 2001, and December 18, 2001, requesting the suspension of Randall Wallin’s 41 teaching license.
