BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘g , OF THE STATE OF OREGON \ In the Matter of the ) Teaching License of ] DEFAULT ORDER WARREN GEORGE ZAIGER ) SUSPENDING LICENSE l On 0r about March 13, 1997, the Teacher Standards and Practices Commission received a complaint from Valva Just, Director of Personnel, McMinnville School District, indicating that Warren George Zaiger had violated his contract by failing to provide 60 days’ notice prior to resignation Under OAR 584-50-020, the Commission informs the educator 0f intent to suspend the license on the basis of such complaints. A notice to Warren Zaiger dated April 7, 1997, informed Mr. Zaiger of his opportunity for hearing on the matter. Zaiger informed the Executive Secretary by telephone he would not request a hearing. FINDINGS OF FACT 1. On or about August 14, 1996, Warren Zaiger signed an employment contract with the McMinnville School District for the 1996-97 school year. 2. On February 11, 1997, Zaiger submitted a letter of resignation and gave the McMinnville School District two weeks’ notice 0f his intent to resign his position as middle school instrumental music teacher on February 21, 1997. The i district was unable to find a qualified replacement for Zaiger. 3. Meeting in regular session on March 10, 1997, the McMinnville School Board of Directors took action to seek a suspension of Zaiger’s teaching license for the balance of the 1996-97 school year and accept his resignation 4. McMinnville School District informed TSPC of this action in a letter dated March 1 1, 1997, requesting the suspension of Zaiger‘s teaching license. ULTIMATE FINDINGS OF FACT Warren George Zaiger signed an employment contract with the McMinnville School District on August 14, 1996. He submitted a letter of resignation dated February 11, 1997. effective February 21, 1997. CONCLUSIONS OF LAW ORS 342.553 requires the suspension of a license for the balance of the school year for failure to provide 60 days’ notice prior to resignation. If the charge of the contract violation is proven, and justification for the contract violation is not satisfactory, the Commission is required to suspend the license for the remainder of the school year.
