6 On August 14, 2003, the Teacher Standards and Practices (Commission) issued a Notice
7 of Opportunity for hearing for Rodger Wayne Van Siereveld, proposing to impose discipline
8 under ORS 342.177. Mr. Van Siereveld requested a hearing to contest the allegations in the
9 notice. .
lO After review of the matters alleged, lVIr. Van Siereveld and the Commission have agreed
ll that their respective interests, together with the public interest are best served by a stipulation to
12 certain facts and a public reprimand followed by a period of probation for one year.
.3 In entering into this stipulation, Mr. Van Siereveld waives his right to a hearing. This
l4 Stipulation and Order are subject to approval by the Commission. If the Commission does not
15 approve the Stipulation and Order, it is understood that any waiver of rights by Mr. Siereveld is
16 revoked and that any statements contained in this Stipulation may not be used by the
l7 Commission or Mr. Van Siereveld for any reason.
l8 STIPULATION OF FACTS
l9 Mr‘ Van Siereveld and the Commission stipulate as follows:
20 1. M. Van Siereveld holds a substitute teaching license which is valid through
21 October 28, 2005.
22 2. Over the last several years, Mr. Van Siereveld has been employed as a substitute
23 teacher by The Dalles School District and Chenowith School District.

l 3. OniNovember l, 2002, Mr. Van Siereveld was working as a substitute teacher in a
.2 third grade classroom at the Colonel Wright Elementary School in The Dalles School District.
3 On that date, children in the classroom were discussing “trick-or-treat” activities that the children
4 had engaged in on Halloween.
5 4. One or more of the children asked Mr. Van Siereveld whether he had celebrated
6 Halloween. Mr. Van Siereveld responded to the children that he did not celebrate Halloween
7 because he understood from television reports that a group of persons had abducted children
8 during Halloween and had drunk the blood of children.
9 5. Some of the children reported Mr. Van Siereveld’s comments to their parents, and
10 the parents made a complaint to the school.
ll 6i Mr. Van Siereveld’s comments were inappropriate for third graders.

17 CONCLUSIONS OF LAW
18 1. Mr. Van Siereveld did not use good professional judgment when he made the
19 comments to children in his third grade classroom in violation of OAR 584-020-0010(5).

1 ORDER
Q The Commission imposes a public reprimand on Rodger Wayne Van Siereveld, and this
3 Order shall serve as the public reprimand. The Commission also places Mr. Van Siereveld on
4 probation for a period of one year. During the period of probation, Mr. Van Siereveld shall
5 comply with all Standards for Competent and Ethical Performance under OAR 584 Division 020.
6 Violation of a condition of probation may constitute an independent basis for the Commission to
7 impose discipline, subject to Mr. Van Siereveld’s right to a hearing on the issue of whether he
8 violated probation. -£&
