Mr. Van Siereveld requested a hearing to contest the allegations in the 9 notice. . lO After review of the matters alleged, lVIr. Van Siereveld and the Commission have agreed ll that their respective interests, together with the public interest are best served by a stipulation to 12 certain facts and a public reprimand followed by a period of probation for one year. .3 In entering into this stipulation, Mr. Van Siereveld waives his right to a hearing. This l4 Stipulation and Order are subject to approval by the Commission. If the Commission does not 15 approve the Stipulation and Order, it is understood that any waiver of rights by Mr. Siereveld is 16 revoked and that any statements contained in this Stipulation may not be used by the l7 Commission or Mr. Van Siereveld for any reason. l8 STIPULATION OF FACTS l9 Mr‘ Van Siereveld and the Commission stipulate as follows: 20 1. M. Van Siereveld holds a substitute teaching license which is valid through 21 October 28, 2005. 22 2. OniNovember l, 2002, Mr. Van Siereveld was working as a substitute teacher in a .2 third grade classroom at the Colonel Wright Elementary School in The Dalles School District. 3 On that date, children in the classroom were discussing “trick-or-treat” activities that the children 4 had engaged in on Halloween. 5 4. One or more of the children asked Mr. Van Siereveld whether he had celebrated 6 Halloween. Mr. Van Siereveld responded to the children that he did not celebrate Halloween 7 because he understood from television reports that a group of persons had abducted children 8 during Halloween and had drunk the blood of children. 9 5. The Commission also places Mr. Van Siereveld on 4 probation for a period of one year.
