9 On March 12, 1997 the Teacher Standards and Practices Commission issued a
10 Substitute Teaching License to Elizabeth Robitaille, contingent upon clearance of the
11 fingerprint cards submitted with her application. Ms. Robitaille's fingerprint cards
l2 were rejected by the Oregon State Police or the FBI. She has been notified at least
13 twice by U.S. Certified Mai1—-Return Receipt Requested and U.S. First Class Mail that
l4 new prints are required for resubmission, but she has not responded to the re-
15 requests.

17 FINDINGS OF FACT

19 l. Elizabeth Robitaille has applied for licensure and was issued a Temporary
20 Substitute Teaching License pending clearance of fingerprints by the Oregon
21 State Police and FBI.

23 2. TSPC informed Ms. Robitaille by U.S. Certified Mail--Return Receipt Requested
24 and U.S. First Class Mail that her fingerprint cards had been rejected. The
25 Commission provided at least 21 days for the applicant to respond.

" 27 3. Robitaille has not responded to TSPC notices requesting resubmission of
28 fingerprint cards.

32 Refusal to be fingerprinted is grounds for denial of licensure under ORS 342.223(2).

36 The Commission suspends the Temporary Substitute Teaching License
37 #287134,issued to Elizabeth Robitaille, , for failure to comply with
38 fingerprint requirement. Suspension to continue until fingerprint requirement is met.
