11 On or about May 28, 1998, the Teacher Standards and Practices Commission received 1
12 information from the Centennial School District, indicating that Michael Allen 1
13 Ferguson, a teacher in the district, had been arrested and charged with Sex Abuse III . 1
14 On August 12, 1998, the Commission received information from the Multnomah ‘
15 County District Attorney that Ferguson had enter a plea of “guilty” to Sex Abuse III ‘
16 and was sentenced in Multnomah County Circuit Court. The Executive Director took
17 action to notify Ferguson of intent to revoke his Oregon Teaching License, and to ‘
18 inform him of his opportunity for hearing. The notice, dated August 24, 1998, and ‘
19 signed by David V. Myton, Executive Director, was sent by U.S. Certified Mail, Return
20 Receipt Requested and U.S. First Class Mail. Mr. Ferguson did not request a hearing.

24 1. Michael Allen Ferguson holds a Standard Teaching License with Handicapped
1' 25 Learner II endorsement valid from December 4, 1997 to November 11, 2002.

27 2. Ferguson was employed as a special education teacher at Centennial High
28 School.

30 3. On August 12, 1998, Ferguson entered a plea of “guilty” to one count of Sex
31 Abuse III in Multnomah County Circuit Court.

33 4. This crime involved a 16-year-old female student at Centennial High School.

37 On August 12, 1998, Michael Allen Ferguson plead “guilty” to one count of Sex Abuse
38 III in Multnomah County Circuit Court.

40 CONCLUSIONS OF LAW

42 Under ORS 342.175 conviction for the crime of Sex Abuse III requires the Commission
43 to revoke the license of an educator.
