JOHNSTON ) RIGHT TO APPLY 6 On or about December 1, 2005, the Teacher Standards and Practices Commission 7 (Commission) received a report from Dan Morin, Superintendent, Port Orford-Langlois School 8 District indicating that Wanda R. Johnston (Johnston) exhibited very strange behavior in the 9 classroom While substituting teaching at Pacific High School and was relieved of her duties mid- 10 day, 11 Ms. Johnston fully cooperated with the Commission’s investigation. After review 0t the 12 matters alleged, Ms. Johnston and the Commission agree that their respective interests, 13 together with the public interest, are best served by a stipulation to certain facts and a surrender 14 of her right to apply teaching license as per OAR 584-050-0027. 5 This document sets forth the facts upon which the parties have agreed and the ‘ stipulated sanction to be imposed. Ms. Johnston stipulates that there is sufficient evidence in 17 the Commissions files and records to suppon the findings of fact, conclusions of law, and order 18 set forth below. 19 By signing below, Ms. Johnston acknowledges, understands, stipulates, and agrees to 20 the following: (i) she has been fully advised of her rights to notice and a hearing to contest the 21 findings of tact, conclusions of law, and order set forth below, and fully and finally waives all 22 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 23 Order of Surrender 0f Right to Apply (Stipulation and Final Order); (ii) this Stipulation and Final 24 Order is a public document and disclosed to the public upon request by the Commission; 25 (iii) this Stipulation and Final Order is contingent upon and subject to approval and adoption by 26 the Commission. If the Commission does not approve and adopt this Stipulation and Final 27 Order, then neither Ms. Johnston nor the Commission are bound by the terms herein; (iv) she O Page 1 STIPULATION OF FACTS AND FINAL ORDER OF SURRENDER OF RIGHT TO APPLY - JOHNSTON 1 has fully read this Stipulation and Final Order, and understands it completely; (v) she voluntarily, 2 without any force or duress, enters into this Stipulation and Final Order and consents to .5 issuance and entry of the Stipulated Final Order below; (vi) she states that no promises or 4 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) 5 she has consulted with an attorney regarding this Stipulation and Final Order and has been fully 6 advised with regard to her rights thereto, or waives any and all rights to consult with an attorney 7 prior to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 8 Final Order below. Ms. Johnston understands that the Commission will suspend her right to 9 apply for a year. 10 STIPULATION OF FACTS 11 1. Ms. Johnston has been licensed by the Commission since February 28, 1983. The 12 Commission issued a Substitute Teaching License to Ms. Johnston on November 7, 2002, valid 13 until March 21, 2006, with a Substitute Any Specialty Endorsement. 4 2. On October 11, 2005, while substituting at Pacific High School, Ms. Johnston i exhibited unusual behavior in the classroom and it was determined by staff that Ms. Johnson 16 was unable to perform her duties. When relieved of her duties Ms. Johnston became 17 disorientated in the parking lot of the school. 18 3. On April 24, 2006, Ms. Johnston told the Commission's investigator that she 19 remembers very little about her behavior on October 11. 2005, but does not dispute 2O Superintendent Morin’s description of her behavior in his report of November 28, 2005. 21 Ms Johnson told the Commission’s investigator that she had not appiied to renew her Substitute 22 Teaching license because she did not belong in a classroom at this time. 23 lT IS SO STIPULATED AND AGREED TO: 24 ‘~DQAA61Q9: Sohnstvh L0 , 2Q’ 0% 25 Wand . Johnston's unusual behavior while substitute teaching on October 11, 2006, .5 at Pacific High School in the Port Orford-Langlois School District and her admission that she 4 does not belong in a classroom at this time are evidence that Ms. Johnston may lack of fitness 5 to serve as an educator. The Commission has authority to impose discipline in this matter 6 under ORS 342.120 through 342.430 and OAR Chapter 584. 7 ORDER 8 The Commission adopts and incorporates herein the above finding of facts and 9 conclusions of law, and based thereon, hereby suspends the right of Wanda R. Johnston to 1O apply for a teaching license for one year from the date of this order. After the period of 11 suspension of her right to apply, Ms. Johnston may apply for reinstatement of licensure 12 pursuant to OAR 584-050-0015(3).
