BROWN ) RIGHT TO APPLY FOR LICENSURE 7 8 On December 14, 2007, the Teacher Standards and Practices Commission (Commission) - 9 issued a Notice of Opportunity for Hearing to Ross M. Brown (Brown) in which the Commission 10 charged him with misconduct under ORS 342.175. The Notice was sent via U.S. First Class Mail and 11 U.S. Certified Mail Receipt 7006 0810 0001 4602 2124 to the address Mr. Brown provided to the 12 Commission. The U.S. First Class Mail was signed by Deborah Brown and returned to the 13 Commission on December 201, 2007. The Notice of Opportunity of Hearing, dated December 14, 14 2007, and signed by Victoria Chamberlain, Executive Director, stated: 15 "You, Ross M. Brown, are entitled to a hearing on the proposed action of the 16 Commission. If you want a hearing, you must file a written request for a hearing with 17 the Commission within 21 days of the date of this notice. Attached to this notice is a > 18 copy of the procedures, right of representation and other rights of parties relating to the 19 conduct of a hearing as required under ORS 183.413(2)." 3(1) Mr. Brown did not request a hearing. The Commission, therefore, finds 22 Mr. Brown to be in default and enters the following findings of fact, conclusions of law and 23 order, based on the tiles and records of the Commission concerning this matter. 24 FINDINGS OF FACT 25 1. The Commission first licensed Mr. Brown on July 25, 2000. On November 5, 2002, the 26 Commission issued Mr. Brown an Initial Teaching l License with a General Business Endorsement. 27 Said license expired on September 19, 2006. 28 2. During the fall semester of 2005, while employed by the Jackson County School District, 29 Mr. Brown used district computer systems and equipment at Eagle Point High School to access 30 sexually explicit materials. This conduct constitutes gross neglect of duty in violation of OAR 584- 31 020-0040(4)(q). PAGE 1 — DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY — BROWN 1 3. TSPC attempted to contact Mr. Brown regarding the investigation of the District's 2 complaint regarding inappropriate internet use. Mr. Brown failed to respond to the Commission's 3 requests for information. This conduct constitutes gross neglect of duty in violation of OAR 584-020- 4 0040(4)(p). 5 CONCLUSIONS OF LAW 6 Mr. Brown's knowing and substantial use of computer equipment to receive, store, produce or 7 send sexually explicit materials constitutes Gross Neglect of Duty in violation of OAR 584-020- 8 0040(4)(q). Mr. Brown's failure to respond to the Commission’s requests for information constitutes 9 Gross Neglect of Duty in violation of OAR 584-020-0040(4)(p). The Commission’s authority to impose 10 discipline in this matter is based upon ORS 342.175. II ORDER I 12 The Commission hereby revokes Ross M. Brown's right to apply for a teaching license.
