By signing below, Respondent acknowledges, understands, stipulates, and agrees to the following: (i) he has been fully advised of his rights to notice and a hearing to contest the - findings of fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any rights to appeal or otherwise challenge this Consent Order; (ii) this Consent Order is a public document and disclosed to the public upon request by the Commission; (iii) this Consent Order is contingent upon and subject to approval and adoption by the Commission. If the Commission does not approve and adopt this Consent Order, then neither Respondent nor the Commission are bound by the terms herein; (iv) he has fully read this Consent Order, and understands it completely; (v) he voluntarily, without any force or duress, enters into this Consent Order and consents to issuance and entry of the Consent Order below; (vi) he states that no promises or representation has been made to induce him to sign this Consent Order; and (vii) he has consulted with an attorney regarding this Consent Order and has been fully advised with regard to his rights thereto, or waives any and all rights to consult with an attorney prior to entering into this Stipulation and Final Order and issuance and entry of the Consent Order. ‘ Findings of Fact 1. The Commission revoked respondent’s teaching license on March 28, 2007 pursuant t0 ORS 342.143(2) 2. On September 10, 2010, Respondent submitted an application to the Commission seeking to reinstate his teaching license. 3. The Commission considered Respondent’s application for reinstatement and on February 22, 2011, issued a Notice of Denial of Application for Reinstatement and Opportunity for Hearing. 4. On March 28, 2011, Respondent requested a hearing on the Commission’s Notice of Denial. 5. The matter was referred to the Office of Administrative hearings and a hearing was scheduled for February 14, 2012. Stipulations 1. Respondent’s application for reinstatement of teaching license is hereby withdrawn. 2. Respondent is not eligible to apply for a teaching license from Commission for one year from the date of this Consent Order.
