1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION , ‘ 2 0F THE STATE OF OREGON . 3 4 In the Matter of the l 5 Teaching License of ) DEFAULT ORDER 6 ANDREW JAY LOCKWOOD ) REVOKING RIGHT TO 7 ) REINSTATE LICENSE 8 9 On or about December 8, 1998, the Teacher Standards and Practices Commission received a 10 judgment and sentencing report from Multnomah County Circuit Court, indicating that Andrew 11 Jay Lockwood had been convicted of three counts of Attempted Sex Abuse III on July 13, 1998. 12 On January 15, 1999, the Commission took action to charge Lockwood with violation of TSPC 13 Standards based on this conviction. The Executive Director notified Mr. Lockwood of intent to 14 revoke his right to reinstate his teaching license, and to inform Lockwood of his opportunity for 15 hearing. The notice, dated January 25, 1999, and signed by David V. Myton, Executive 16 Director, stated: 17 18 "You, Andrew Jay Lockwood, are entitled to a hearing on the proposed l9 revocation of your right to reinstate your Oregon Teaching License. If you desire 20 a hearing, you must notify the Executive Director of the Commission, in writing, 21 within 21 days of the date of this notice." 22 t 23 The notice of opportunity for hearing was sent by U.S. Certified Mail, Return Receipt Requested i 24 #P 412 422 614. The receipt was signed on January 28, 1999 and returned to TSPC. Mr. f 25 Lockwood did not request a hearing. 1 26 27 FINDINGS OF FACT . 28 29 l. Andrew Jay Lockwood held a Basic Teaching License with elementary endorsement . 3O valid from June 7, 1995 to September 25, 1998. 31 32 2. On July 13, 1998, Andrew Jay Lockwood was convicted of three counts of Attempted 33 Sex Abuse in the First Degree in Multnomah County Circuit Court. On December 3, 34 1998, Lockwood was sentenced to 32 months imprisonment; 60 months post~prison 35 supervision; and ordered to pay $5,000 in restitution to victims. 36 37 3.
