1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter Of the ) STIPULATION OF FACTS Teaching License of ) CONCLUSIONS OF LAW 4 CASSANDRA MOORE ) AND ORDER ' ) 5 . 6 On or about August 27, 1996, the Teacher Standards and 7 Practices Commission (Commission) issued an Amended Notice of 8 Opportunity for Hearing to Cassandra Moore (Moore) in which the 9 Commission proposed to suspend or revoke Moore's Oregon teaching 10 license or to impose other discipline under ORS 342.177. 11 The Commission and Moore have now reviewed the matters 12 alleged and have agreed to the following stipulation. In 13 entering this stipulation, Moore waives her right to a hearing Q ‘ 14 and her right to challenge the imposition of discipline. Moore 15 has agreed to do so in order to settle this dispute with TSPC and 16 to avoid a lengthy hearing. She agrees that the stipulated facts 17 set forth below are supported by evidence in the record, and she 18 agrees that, in hindsight, she exercised poor judgment. However, l9 she believes that the stipulated facts are incomplete and . 20 therefore misleading. She also disagrees that those facts 21 justify the Commission's Conclusions of Law and Order. 22 STIPULATION OF FACTS 23 1. Moore has held an Oregon standard teaching license with an endorsement in art since August 1, 1990. Her current 24 license is valid through December 22, 1999. . , 1 25 2. During the 1994-95 school year, Moore exercised poor . judgment as described below in her interactions with J.S., 2 a 16 year old female student in her junior year at North Medford High School. 3 4. In December 1994, Moore learned that J.S. had experienced 4 emotional problems since about the eighth grade, that she had undergone counseling, that she experienced suicidal 5 thoughts and that she had an "as needed" prescription for antidepressant medication. 6 5. On Christmas Day 1994, Moore disclosed to J.S. highly 7 personal information about Moore's life, relating to her experience of sexual abuse. Moore also told J.S. that Moore 8 had not shared this information with any of Moore's family members. 9 1 6. On New Year's Eve 1994, Moore was contacted by a friend of 10 J.S. who informed Moore that J.S. was ill from consumption of alcohol and marijuana. Moore picked up J.S. and took her 11 to Moore's home where J.S. spent the hours of 3 a.m. to 8 a.m. alone with Moore. Moore returned J.S. to her 12 friend's home on January 1, 1995. Later that day, Moore learned from J.S. that J.S. had taken twice the normal l3 dosage of her "as needed" tranquilizer. Moore did not inform J.S.’s parents about what had occurred. She did l4 report the New Year's Eve incident to J.S.’s school . counselor on January 3 or 4, 1995. , 15 7. On January 3, 1995, J.S. and two or three other students 16 drank wine coolers during the school lunch hour off school grounds. Moore learned about this fact from one of the 17 involved students after school hours of January 3, 1995. Moore did not report this incident to school authorities for 18 disciplinary action. l9 8. In early January and with the consent of J.S.’ parents, Moore arranged for J.S. to undergo counseling from a private 20 therapist. 21 9. On January 19, 1995, J.S. came to Moore's home in an emotionally upset state following a counseling session. 22 Moore has testified and the Commission finds that on this occasion J.S. expressed a very strong emotional and romantic 23 attachment to Moore. Moore rejected these overtures but held J.S.’s hand, hugged her, and gave her a kiss on the 24 cheek at the door. 25 lO. Under policies of the Medford School District, Moore was expected as a teacher to maintain a professional 26 relationship with students inside and outside the classroom. Salem, Oregon 97310 (503)37346003 ' 1 Moore enters into this Stipulation of Facts with the 2 knowledge that the Teacher Standards and Practices Commission 3 will issue a six month suspension commencing on the date of this 4 Order and continuing through May 15, 1999, followed by a two year 5 period of probation. This Stipulation is contingent upon 6 approval and adoption of the Order by the Commission. Moore demonstrated poor judgment and a failure to . maintain a professional relationship with students in ' 2l Violation Of OAR 584-20-040(4) (n) and 584-20-035(l) in the following instances: 22 a. On January 1, 1995, Moore allowed J.S. to spend . the hours 3 a.m. to 8 a.m. alone with Moore in Moore's 2 home when J.S. was ill from the consumption of marijuana and alcohol; Moore failed to inform J.S.’s 3 parents of the incident. 4 c. On January l9, 1995, Moore held J.S.’s hand, ' hugged J.S. and kissed J.S. on the cheek after J.S. 5 came to Moore's home and expressed a strong emotional and romantic attachment to Moore. 6 2. On January 3, 1995, Moore failed to follow established 7 district policies in violation of OAR 584—20—O40(4)(n) and 584-20-035(2)(b) when she learned that J.S. and 8 other students had consumed alcohol during the school lunch period but failed to make a disciplinary referral 9 to school officials. 10 ORDER 11 Based upon the above Findings of Fact and Conclusions of 12 Law, the Commission orders the following: 13 1. Moore's Oregon teaching license shall be suspended for a period commencing with the date of this Order and .14 continuing through May 15, 1999; 15 2.
