Under this notice, the Commission l4 acknowledged Park's request for a hearing based on the denial of 15 his application for an administrative license. On August 20, 16 1996, the Commission also issued a Notice of Hearing concerning 17 Park's teaching license and proposed to suspend, revoke or 18 otherwise discipline Park. Park requested a hearing to contest l9 the allegations contained in the notices. After a review of the 20 matters alleged, the parties have agreed that their respective 21 interests, together with the public interest, are best served by a 22 stipulation to certain facts and the imposition of a public 23 reprimand and a period of probation. '. ' (I. r ' 1 STIPULATED FACTS 2 Park and the Commission agree that the following facts are 3 true: - 4 1. Park holds a standard Oregon teaching license with S endorsements in social studies and physical education. On August 6 11, 1996, Park applied for an administrative license, and his 7 application was denied based on the misconduct described below. 8 2. On May 17, 1996, Park entered a plea of guilty in Marion 9 County District Court to the crime of Theft II, based on the 10 charge that he committed theft of money, checks or property, from 11 the Salem-Keizer School District with a total value of $50 or 12 more. The court accepted Park's plea of guilty, placed Park on l3 probation for a period of 24 months, subject to the conditions . 14 that he perform 160 hours of community service, that he not teach 15 during the period of probation, and that he pay restitution and 16 court costs. Under the terms of Park's plea agreement, the 17 charges against him will be dismissed if Park successfully 18 completes all terms of probation. l9 3. This case concerns Park's mishandling of accounts when 20 Park was in charge of supervising a student store at Leslie Middle 21 School. He maintains that the overpayments he received were the 22 result of poor recordkeeping rather than a deliberate attempt to 23 steal money from the school. Park agreed to repay approximately 24 $380 to the school. Park failed to maintain adequate records. 25 /// ' 26 /// ‘ PAGE 2 - STIPULATION, PUBLIC REPRIMAND a ORDER OF PROBATION (DOUGLAS DEAN PARK) '- ' I ( a’ . l The parties acknowledge that upon execution of this 2 stipulation, the Commission will enter an order denying Park's 3 application for an administrative license at this time, and 4 issuing a public reprimand and period of probation with respect to 5 Park's teaching license. 6 This stipulation and order is subject to review and approval 7 by the full Commission. Should the Commission fail to approve 8 this stipulation and proposed order as written, it is understood 9 that any waiver of rights by Park is therefore revoked. 'yton, 1 ecutive Secretary of Date 17 Teacher Standards and Practices Commission l8 CONCLUSION OF LAW 19 Park's conduct constitutes a violation of the Standards for 20 Competent and Ethical Performance of Oregon Educators under 21 OAR 584-20-040(4) (b) and (5) (e). 22 DISCUSSION 23 Although the misconduct in this case concerns Park's 24 professional duties at school, it appears to the Commission that 25 his conduct did not involve the deliberate misappropriation of . 26 school funds. For this reason, the Commission elects to impose PAGE 5 - STIPULATION, PUBLIC REPRIMAND a ORDER OF PROBATION (DOUGLAS DEAN PARK) ' l the relatively mild sanction of a public reprimand and period of 2 probation as to Park's teaching license. 3 Because administrators have significant fiscal ' 4 responsibilities, the Commission concludes it would not be S appropriate to approve Park's application for an administrative 6 license at this time. 7 ORDER 8 l. The Commission imposes a public reprimand on 9 Douglas Dean Park, and this Order shall serve as the public 10 reprimand. 11 ' 2.
