~ 1 STATE OF OREGON ' 2 TEACHER STANDARDS AND PRACTICES COMMISSION 3 In the Matter of the Teaching License of DEFAULT ORDER OF 4 GARY DE CRABAUGH REVOCATION 5 l 6 On January 27, 1999, the Teacher Standards and Practices Commission (Commission) 7 issued a Notice of Opportunity for Hearing to Gary De Crabaugh, charging him with 8 professional misconduct and advising him that the Commission may take action to suspend or 9 revoke his Oregon Teaching License. The notice further advised MI. Crabaugh that he must ,. 10 request a hearing within 21 days of the date of the notice or the Commission would enter an 11 order of default. On about February 7, 1999, Mr Crabaugh’s attorney informed the Commission ' 12 that Mr. Crabaugh has elected not to contest the allegations in the notice and would allow an ‘ l 13 order to be entered by default‘ Mr‘ Crabaugh’s attorney fithher stated that Mr‘ Crabaugh does l4 not admit the allegations in the notice, but he chooses not to request a hearing because he is not 15 engaged in teaching and does not want to incur the expense of a hearing, , 16 The Commission finds Mr. Crabaugh to be in default. Based on the files and records in 17 this matter the Commission enters the following findings of fact, conclusions of law and order of ‘ 18 default. l l9 FINDINGS OF FACTS l 20 11 Mr. Crabaugh holds a Standard Oregon Teaching License. Beginning in the fall of 1971, Mr. Crabaugh developed a sexual relationship with 2 a 14-year-old female student at Roosevelt Middle School. The sexual contacts included sexual 3 intercourse. Many of the sexual contacts occurred at the school site, and they continued on about 4 a weekly basis for the remainder of the 1970-71 school year, 5 3. The sexual contacts between Mr, Crabaugh and the student continued on an 6 intermittent basis afler the student transferred to high school and through the student’s 18th 7 birthday in September 1975. 8 2. The student reported these matters to the Commission in N0vemberl998. 9 Mr. Crabaugh chose not to respond to the student’s allegations. 10 ULTIlVIATE FINDING OF FACT AND CONCLUSION OF LAW 11 Mr. Crabaugh had sexual contact with a student during the period from the fall of 1970 12 through September 1975.
