1 BEFORE THE TEACHIS STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND FINAL ORDER OF 5 LISA MARIE PAGE ) REPRIMAND AND PROBATION 6 On October 9, 2007, the Teacher Standards and Practices Commission (Commission) 7 received a completed 0-1 application for educator liwnse application from Lisa Marie Page, wherein 8 she indicated past criminal convictions. 9 Ms. Page fully cooperated with the Commission's investigation. After a review of the matters 10 alleged, Ms. Page and the Commission agree that their respective interests, together with the public 11 interest, are best served by a stipulation to certain facts and a public reprimand. 12 This document sets forth the facts upon which the parties have agreed and the stipulated 13 sanction to be imposed. Ms. Page stipulates that there is sufficient evidence in the Commission's files 14 and records to support the findings of fact, conclusions of law, and order set forth below. 15 By signing below, Ms. Page acknowledges, understands, stipulates, and agrees to the 16 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of 17 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any 18 rights to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand 19 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to 20 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon 21 and subject to approval and adoption by the Commission. If the Commission does not approve and 22 adopt this Stipulation and Final Order, then neither Ms. Page nor the Commission are bound by the 23 terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely; 24 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and 25 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no promises or 26 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) she has 27 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with 28 regard to her rights thereto, or waives any and all rights to consult with an attorney pn'or to entering Dana 1 - RTIPI n ATIQN OF FACTS AND FINAL ORDER OF REPRIMAND - PAGE 1 into this Stipulation and Final Order.. This Order sets forth the facts upon which the parties have 2 agreed and the sanction to be imposed. Ms. Page stipulates that there are sufficient facts contained 3 in the Commission's files and records to support the findings of fact and conclusions of law set forth 4 below. In entering into this stipulation, Ms. Page waives the right to a hearing to contest the findings 5 of fact, conclusion of law and order set forth below. 6 STIPULATION OF FACTS 7 1. Ms. Page previously held a Basic Teaching license with an endorsement in Basic 8 Elementary Education, issued Auguet 23, 1993, which expired May 17, 1997. Ms. Page is currently 9 applying to reinstate this license. 10 2. Ms. Page was convicted for Driving Under the Influence of lntoxicants (DUll) on four 1 1 occasions between December 2004 and March 2006. Ms. Page was also convicted for Reckless 12 Endangering on December 13, 2004. 13 3. This constitutes Gross Unfitness in violation of OAR 584-020-0040(5)(c). The 25 Commission has the authority to impose discipline in this matter under ORS 342.120 through 342.430 26 and OAR Chapter 584. ' 27 /// ‘ 28 /// f9 / / / Page 2 - STIPULATION OF FACTS AND FINAL ORDER 0F REPRIMAND - PAGE 1 FINAL ORDER 2 The Commission hereby adopts and incorporates herein the above findings of fact and 3 conclusions of law and hereby imposes a Public Reprimand on Lisa Marie Page. This Order shall 4 serve as the Public Reprimand. 5 Furthermore, the Commission places Ms. Page on Probation for a period of four (4) years 6 subject to the following terms and conditions: 7 1. Ms. Page shall, at her own initiative and expense, continue to obtain treatment for her 8 alcohol dependency as recommended by her alcohol treatment provider and abstain from the 9 consumption of alcohol; 10 2. During the period of this probation, Ms. Page shall submit to the Executive Director of the 1 1 Commission reports of her compliance with her treatment plan. Ms. Page shall provide these reports 12 every six (6) months during her probation, beginning August 8, 2008; 13 3. Ms. Page shall report in writing within ten days to the Executive Director of the Commission 14 any arrest or citation for any felony, misdemeanor, major traffic violation or violation of criminal 1 5 probation; and 16 4. Ms. Page shall comply with the Standards for Competent and Ethical Performance of 17 Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020. 18 ' Wolation of any term or condition of probation shall constitute an independent basis for the 19 Commission to revoke Ms. Page's teaching license or otherwise impose discipline, after first providing 20 Ms. Page with notice and opportunityfor hearing.
