Thereafter Mr. White requested a 9 hearing through his attorney, Henry Kaplan. The Commission and 10 Mr. White have now reviewed the issues connected with this 11 proceeding and have determined that their respective interests 12 are best served by a stipulation to certain facts and a 13 suspension of Mr. White's Oregon teaching license. Mr. White , l4 understands in entering into this stipulation that he waives his 15 right to a hearing and that the Commission will suspend his 16 teaching license for a period of nine months. 1'7 STIPULATED FACTS 18 Mr. White and the Commission stipulate as follows: 19 1. Mr. White holds a standard Oregon teaching license with 2O subject matter endorsements in Physical Education and 21 Mathematics. . 22 2. On February 1, 1992, the Commission placed Mr. White on 2 probation for a period of two years based on the following: 3 convictions for driving under the influence of intoxicants in 4 1988, 1990 and 1991; incorrectly answering questions regarding 5 major traffic convictions on his application for a teaching 6 certificate; appearing under the influence of intoxicants at a 7 district-sponsored football game. 8 4. On June 16, 1993, Mr. White was convicted in Washington 9 County District Court of driving while suspended based on an 10 incident that occurred on April 10, 1993. 11 5. On January 22, 1998 Mr. White was convicted in 12 Washington County District Court of driving under the influence 13 of intoxicants based on an incident that occurred on March 28, .14 1996. 15 6. My on, Exe utive Director Date 10 Teacher Standards and Practices Commission 11 ULTIMATE FINDING OF FACTS 12 Since the Commission placed Mr. White on probation in 1992 13 for alcohol-related offenses, he has been convicted of three .14 major traffic offenses, including one conviction for driving 15 under the influence of intoxicants. 16 CONCLUSIONS OF LAW 17 The above conduct constitutes gross unfitness in violation 18 of OAR 584-020-0040(5)(c) and gross neglect of duty in violation 19 of OAR 584-020-oo4o(4) (c). ' 20 DISCUSSION 21 The Commission finds a pattern of alcohol-related misconduct 22 that continued after the Commission last imposed a disciplinary 23 sanction in 1992.
