BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the Case No. 114974 Teaching License of 4 SURRENDER OF LICENSE AND 5 ADAM TYLER REESE ' STIPULATED ORDER 6 The Teacher Standards and Practices (Commission) issued a Notice of Denial of 7 Teaching License and Opportunity for Hearing on November l2, 2003 to Adam Tyler Reese. 8 The Notice was subsequently amended on July 12, 2004. Mr. Reese requested a hearing, and the 9 case was assigned to Administrative Law Judge Catherine Coburn and scheduled for hearing on 10 September 15, 2004. 1 1 After a review of the matters alleged, the Commission and Mr. Reese have agreed that their respective interests, together with the public interest, are best served by a stipulation to Q certain facts, the surrender of Mr. Reese’s teaching license and the revocation of Mr. Reese’s 14 right to apply for a teaching license. 15 In entering into this stipulation, Mr. Reese waives his right to a hearing and understands l6 that the Commission will deny his application for renewal of his teaching license and revoke his 17 right to apply for a license. This stipulation and proposed order are contingent on approval by 18 the full Commission. If the Commission does not approve this stipulation and order, it is 19 understood that any waiver of rights by Mr. Reese is therefore revoked. It is further understood 20 that the statements contained in this stipulation may not be used by either the Commission or Mr. 21 Reese for any reason if the Commission fails to approve the stipulation and proposed order. 22 5 Page 1 - STIPULATION AND ORDER — ADAM TYLER REESE — GENK0828.dOC ‘ STIPULATION OF FACTS 2 Mr. Reese and the Commission stipulate as follows: 3 l. Mr. Reese holds an Oregon Basic Teaching License with a basic endorsement in 4 elementary education. 5 2. Mr. Reese was employed as a coach for the girls basketball team at the Mountain 6 View High School in the Bend-LaPine School District during the 2002-2003 school year. 7 3. During the spring of 2003, Mr. Reese failed to maintain an appropriate teacher 8 student relationship with an 18-year senior player on the basketball team. 9 4. During this period, Mr. Reese expressed a professionally inappropriate interest in 10 the student’s personal life. He and the student discussed issues relating to the student’s personal ll and family life, and he did not refer the student to a school counselor or report these issues to a school counselor or other school official. ‘3 5. During this period, Mr. Reese also took the student on trips alone in his vehicle, l4 and on several occasions he allowed the student to visit him alone at his home during late hours. 15 6. The Commission finds that Mr. Reese allowed the student to stay overnight in his l6 home on at least one occasion. Mr. Reese denies that the student stayed overnight in his home, l7 but he acknowledges that there is sufficient evidence in the record for the Commission to make l8 this finding and stipulates that the Commission may do so. 19 7. His conduct as described in the Stipulated Facts constitutes gross neglect of 4 duty in violation of OAR 584-020-0040(4)(o) as that rule incorporates OAR 5 84-020-0035(1(b) 5 and (c). 6 ORDER 7 The Commission accepts the voluntary surrender of the Oregon Teaching License of 8 Adam Tyler Reese and revokes Mr. Reese’s right to apply for a teaching license. 9 Under ORS 342.175(3), any person whose license has been revoked may apply to the 10 Commission for reinstatement after one-year from the date of revocation. If Mr. Reese should ll apply for reinstatement at some future date, the decision would lie within the discretion of the Commissioners who would consider at that time whether Mr. Reese had established Q convincingly that he is fit to hold an Oregon Teaching License as provided under OAR 584-050- l4 0015(4). The Commission expresses no opinion as to what evidence would be sufficient for Mr. 15 Reese to be reinstated.
