I 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND 5 CHRISTINE MARIE PERRIGO ) FINAL ORDER OF REPRIMAND 6 On February 23, 2007, the Teacher Standards and Practices Commission 7 (Commission) received a report from Tim Keeley, Assistant Superintendent, Bethel 8 School District alleging Perrigo failed to follow proper test security guidelines during the 9 proctoring of a state exam. 10 After review of the matters alleged, Ms. Perrigo and the Commission agree that 11 their respective interests, together with the public interest, are best served by a 12 stipulation to certain facts and a public reprimand. 13 This document sets forth the facts upon which the parties have agreed and the 14 stipulated sanction to be imposed. Ms. Perrigo stipulates that there is sufficient 15 evidence in the Commission‘s files and records to support the findings of fact, 16 conclusions of law, and order set forth below. 17 By signing below, Ms. Perrigo acknowledges, understands, stipulates, and 18 agrees to the following: (i) she has been fully advised of her rights to notice and a 19 hearing to contest the findings of fact, conclusions of law, and order set forth below, and 20 fully and finally waives all such rights and any rights to appeal or otherwise challenge 21 this Stipulation of Facts, Final Order of Reprimand (Stipulation and Final Order); (ii) this 22 Stipulation and Final Order is a public document and disclosed to the public by the 23 Commission upon request; (iii) this Stipulation and Final Order is contingent upon and 24 subject to approval and adoption by the Commission. If the Commission does not 25 approve and adopt this Stipulation and Final Order, then neither Ms. Perrigo nor the 26 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and Page 1 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - PERRIGO 1 Final Order, and understands it completely; (v) she voluntarily, without any force or 2 duress, enters into this Stipulation and Final Order and consents to issuance and entry 3 of the Stipulated Final Order below; (vi) she states that no promises or representations 4 have been made to induce her to sign this Stipulation and Final Order; and (vii) she has 5 consulted with an attorney regarding this Stipulation and Final Order and has been fully 6 advised with regard to her rights thereto, or waives any and all rights to consult with an 7 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 8 the Stipulated Final Order below. 9 STIPULATION 0F FACTS 10 1. Ms. Perrigo has been licensed by the Commission since August 25, 1994. 11 Ms. Perrigo currently holds a Basic Teaching License issued November 7, 2007 with a 12 Basic Elementary endorsements. Said license expires November 6, 2010. 13 2. During the proctoring of the Oregon State Writing Assessment, Ms. Perrigo 14 provided assistance to students during the exam by pointing out spelling mistakes for 15 two students asking questions to prompt the correct spelling. Perrigo also indicated to a 16 student that he would benefit from consulting a dictionary or thesaurus. 17 3. Perrigo indicated that she was confused over the amount of encouragement 18 she could give students because the state guidelines have varied over the years. 19 Perrigo further stated that she did not intend to violate the guidelines. 20 // / 21 / / / 22 / // 23 / // 24 / // 25 // l Page 2 STIPULATION OF FACTS AND FINAL ORDER OF REPRIMAND - PERRIGO 1 4. This misconduct constitutes 13 Gross Neglect of Duty, pursuant to OAR 584-020-0040(4)(5)(n) as it incorporates OAR 14 584-020-0020(2)(d). The Commission has the authority t0 impose discipline in this 15 matter under ORS 342.120 through 342.430 and OAR Chapter 584. 16 ORDER 17 The Commission hereby adopts and incorporates herein the above findings of 18 fact, conclusions of law and imposes a Public Reprimand upon the Iicensure of I 19 Christine Perrigo.
