The 12 Notice was sent via U.S. First Class Mail and U,S. Certified Mail Receipt 7002 2410 0001 9754 13 7245 to the address obtained by the Commission. The certified mail receipt was signed and 14 dated on September 19, 2003. The Notice of Opportunity of Hearing, dated September 18, 15 2003, and signed by Victoria Chamberlain, Executive Director, stated: 16 "You, Robert Paul Patton, are entitled to a hearing on the proposed action of the 7 Commission. If you want a hearing, you must file a written request for a hearing ‘ with the Commission within 21 days of the date of this notice. Attached to this ‘ 9 notice is a copy of the procedures, right of representation and other rights of t 20 parties relating to the conduct of a hearing as required under ORS 183.413(2)." i 21 = 22 Mr. Patton did not request a hearing. The Commission, therefore, finds i i 23 Mr. Patton to be in default and enters the following findings of fact, conclusions of law 3 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS 0F FACT . 20 1. Mr. Patton holds a Basic Administrative License issued March 16, 2001, expired 27 December 13, 2003. 28 2. Mr. Patton was employed by the Shenlvood School District as a Principal of 29 Shen/vood High School from July 23, 1998, until resignation on January 8, 2003. On August 8, 2003, Robert Paul Patton was convicted of Possession of Materials '2 Depicting Sexually Explicit Conduct of a Child, ORS 163.688, in the Circuit Court for the State of 3 Oregon for the County of Washington. 4 4. On August 8, 2003, Robert Paul Patton was convicted of two counts of Sexual Abuse 5 Ill, ORS 163.415, in the Circuit Court for the State of Oregon for the County of Washington. 6 CONCLUSIONS OF LAW 7 The crimes of Sexual Abuse |lI as defined in ORS 163.415; and Possession of Materials 8 Depicting Sexually Explicit Conduct of a Child as defined in ORS 163.688 are listed in ORS 9 342.143(3). The Commission is required to revoke the Oregon Basic Administrative License 11) issued to Robert Paul Patton pursuant to ORS 342,175(2). ll ORDER 12 The Commission hereby revokes the Oregon Basic Administrative License issued to 3 Robert Paul Patton and revokes his right to apply for licensure.
