OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION 0F FACTS, 4 Teaching License of ) AND PUBLIC REPRIMAND 5 SHERI ELIZABETH ELLIGSEN ) 6 On or about January 27, 2005, the Teacher Standards and Practices 7 Commission (Commission) received a report from Michael J. Keown, Superintendent, 8 Arlington Public Schools, indicating that Sheri Elizabeth Elligsen (Elligsen) had been 9 arrested for Telephonic Harassment and Stalking. 1O After review of the matters alleged, Ms. Elligsen and the Commission agree that 11 their respective interests, together with the public interest, are best sewed by a 12 stipulation to certain facts and imposition of a Public Reprimand. j 13 This Order sets forth the facts upon which the parties have agreed and the i ' sanction to be imposed. Ms‘ Elligsen stipulates that there are sufficient facts contained 15 in the Commission's files and records to support the findings of fact and conclusions of 16 law set forth below. In entering into this stipulation, Ms. Elligsen waives the n'ght to a 17 hearing to contest the findings of fact, conclusions of law and order set forth below. 18 Ms. Elligsen understands that the probation will be subject to specific conditions. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order, neither Ms. Elligsen nor the 21 Commission are bound by these Stipulations and Ms. Elligsen retains all rights to a 22 hearing on the allegations. 23 /l/ 24 Ill . /// 26 l/ I Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - Elligsen 1 STIPULATION OF FACTS . 1. The Commission has licensed Sheri Elizabeth Elligsen since October 25, 3 1990. Ms. Elligsen currently holds a Conditional Teaching License valid January 30, 4 2006 through January 29, 2009, with an endorsement in Basic Handicapper Learning. 5 2. Ms. Elligsen was employed as a 4"‘ grade elementary teacher by the 6 Arlington Public Schools for the years 2002-2003 and 2003-2004. Ms. Elligsen 7 resigned her position effective August 17, 2004. 8 3. On October 15, 2004, Ms. Elligsen pled guilty, of two (2) counts of Telephonic 9 Harassment, a violation resulting from continuous and unwanted telephone calls in the I 10 Grass Valley, Oregon area. At the time of the conduct, Ms. Elligsen was not 11 supervising minors nor in any official or unofficial teaching capacity. ‘ 12 4. By making repeated, unwanted 25 harassing telephone calls to two citizens of Grass Valley, Oregon during the period of Q August 2003, through May 2004, Sheri Elizabeth Elligsen engaged in an act constituting Page 2 STIPULATION OF FACTS, ORDER 0F REPRIMAND AND PROBATION - Elligsen 1 criminal conduct in violation of OAR 584-020-0040(5)(e). Sheri Elizabeth Elligsen's . conviction for Telephone Harassment violates OAR 584-020-0040(5)(c). This 3 misconduct constitutes Gross Unfitness. The Commission’s authority to impose 4 discipline in this matter is based upon ORS 342.175. 5 ORDER 6 The Commission adopts the above stipulation of facts and imposes a Public 7 Reprimand upon Ms. Elligsen. Furthermore, the Commission imposes a two (2) year 8 probation upon Ms. Elligsen subject to the following terms and conditions: 9 1. Ms. Elligsen shall at her own initiative and expense, obtain a mental health 10 evaluation and seek treatment as recommended by her mental health evaluator acceptable to 11 the Commission. A copy 0f the evaluation will be mailed to the Commission with a statement 12 regarding the likelihood that Ms. Elligson will not repeat the criminal behavior. ‘ 2. During the period of this probation, Ms. Elligsen shall comply with the terms of 14 the treatment and aftercare plans as recommended by medical professional if 15 appropriate; 16 3. Ms. Elligsen shall conduct herself as a law-abiding citizen; ‘ 17 4. Ms. Elligsen shall report in writing within ten days to the Executive Director of 18 the Commission any arrest 0r citation for any felony, misdemeanor, major traffic 19 violation or violation of criminal probation; and 20 5. Ms. Elligsen shall comply with all Standards for Competent and Ethical 21 Performance under Oregon Administrative Rules Chapter 584, Division 020. I 22 /// 23 /// /// Q5 /// Page 3 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION - Elligsen 1 If Ms. Elligsen does not comply with all terms and conditions of this probation, based on . the reports of her treatment provider or as otherwise determined by the Executive 3 Director, she shall be in violation of this probation.
