1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) 4 Teaching License of ) STIPULATION OF FACTS, 5 WILLIAM MARTIN TODD ) ORDER OF REPRIMAND AND 6 ) PROBATION 7 On or about October 28, 2002, the Teacher Standards and Practices Commission 8 (Commission) received a report from Bob Simonson, Deputy Superintendent, Klamath Falls City 9 Schools indicating that William Martin Todd (Todd) was arrested for Driving Under the Influence 1O of lntoxicants (DUII) and Assault as passengers in his vehicle were injured in the crash. 11 After review of the facts in this matter, Mr. Todd and the Executive Director agree that 12 their respective interests, together with the public interest, are best sewed by a stipulation to 13 certain facts, a reprimand followed by a probation of two (2) years. 14 This Order sets forth the facts upon which the parties have agreed and the sanction to 5 be imposed. Mr. Todd stipulates that there are sufficient facts contained in the Commission‘s 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Todd waives the right to a hearing to contest the findings of 18 fact, conclusion of law and order set forth below. Mr. Todd understands that the Commission 19 will impose a two (2) year probation with specific conditions. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Todd nor the 22 Commission are bound by these Stipulations and Mr. Todd retains all rights to a hearing on the 23 allegations. 24 STIPULATION 0F FACTS 25 1. Mr. Todd holds an Oregon Standard Teaching License valid May 9, 2001, to May 12, 26 2006, with endorsements in Standard Language Arts, Basic Biology, Basic Chemistry and i’ Basics Physics. Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION-TODD '1 2. Mr. Todd is employed by Klamath Falls City Schools. He began his employment with 2 the District in September of 1989. 3 3. On November 25, 2002, William Martin Todd was convicted of Recklessly Endangering 4 and DUII in the Circuit Court for the State of Oregon for the County of Harney. The court 5 sentenced Mr. Todd to 20 days in jail, eighteen months probation, and ordered a money 6 judgment of $1 £46.00. Special Conditions of Mr. Todd’s probation include requirements: to pay 7 ordered financial obligations, to obey all laws, inform the court of address change, to answer 8 court inquiry, to remain in State, to complete a drug/alcohol evaluation/treatment/antabuse, not 9 to enter bars, not to consume intoxicants. 1O IT 20 STIPULA, D: / 11 - ’ I'm All /7,¢2009—— 12 WiIIi- 1 a i ’d ‘ Date 13 fi%M/Ml ' M 4 ictoria o ambeain, Exe tive Director Date .5 CONCLUSION OF LAW 16 William Martin Todd’s criminal conviction for Recklessly Endangering and DUII, 17 constitutes gross unfitness as defined in OAR 584-020-0040(5)(c). The Commission's authority 18 to impose discipline in this matter is based upon ORS 342.175. 19 ORDER 20 The Commission adopts the above Stipulation of Facts and orders a Public Reprimand 21 for conviction of the crimes of Recklessly Endangering and DUII. This Order shall serve as the 22 Public Reprimand. 23 The Commission places Mr. Todd on a two (2) year probation to commence January 10, 24 2003, subject to the following terms of probation: 25 a. Mr. Todd shall report in writing within ten days to the Executive Director of the 2 Commission any arrest or citation for any felony, misdemeanor, major traffic violation 3 or violation of court ordered probation, including special conditions; and 4 c.
