l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON 3 In the Matter of the ] STIPULATION OF FACTS 4 Teaching License of ] AND ORDER 5 SUSAN JASA LOE ) OF PROBATION 6 ) 7 On October 12, 1995, Teacher Standards and Practices Commission received 8 information from the Washington County District Attorney indicating that Susan Jasa 9 Loe had been convicted of shoplifting on March 28, 1995. The Executive Secretary 10 requested copies of the court records and Ms. Loe's explanation of the incident and 11 reported the findings to the Commission in Executive Session. The Commission 12 directed the Executive Secretary t0 propose a Stipulation of Facts and Order of 13 Probation as a resolution of this case. 14 STIPULA'I'ION OF FACTS 15 It was determined that the stipulation of the following facts is in the best interest of 16 Susan Loe, the Commission, and the public. 17 1. Susan Jasa Loe holds a Basic Teaching License endorsed in Elementary and 18 valid from March 30, 1993 to April 17, 1996. 3 2. On March 28, 1995, Susan Loe pled guilty to the crime of First Degree Thefl 20 [Class C Felony). This charge was based upon shoplifting 14 garments from 2 l Nordstrom‘s at Washington Square valued at $963. 22 3. The court entered a judgment of conviction for a Class A Misdemeanor and 23 made disposition accordingly. Ms. Loe was placed on probation for a period of 24 one year and required to pay fines and assessments totaling $428. 25 4. Ms. Loe was experiencing depression, anxiety and mood swings at the time of 26 the crime which she attributes to undiagnosed hypoglycemia and premenstrual 27 syndrome. 28 5. Susan Loe has been in therapy since December 28, 1994 to deal with the 29 shoplifting episode. 30 6. On October 17, 1995, Ms. Loe was granted early release from the court ordered 3 1 probation having complied with all special conditions and financial obligations. This Stipulation and proposed Order are contingent upon approval by Susan Loe and the full 4 Commission. Myt n, Execu ve Secretary Date 12 Teacher Standards an Practices Commission 13 OPINION 14 By committing the act of Felony Theft Susan Loe raised serious concerns about her 15 fitness to serve as an educator. Under ORS 342.175 and OAR 584, Division 20, the Q Commission may suspend or revoke the license and educator who was convicted of a crime when such crime has a bearing on the person's ability to fulfill the l8 responsibilities of a licensed position. Parents and the public expect educators to 19 serve as good role models as law abiding citizens. The Commission concludes that a 2O comparatively lenient sanction is appropriate in this case because Ms. Loe has an 21 excellent professional record and, except for this incident, has been an law abiding 22 citizen. The Commission also considered that the court imposed a judgment for 23 conviction of a Class A Misdemeanor and that Susan Loe has complied with and 24 completed all conditions of probation set by the court. Based upon the statements of 25 Ms. Loe, her counselor, and the her probation officer, the Commission believes a 26 recurrence of shoplifting is extremely unlikely. 27 ULTIMATE FINDINGS OF FACT 28 On March 28, 1995, Susan Jasa Loe plead guilty to Felony Theft and was convicted 29 for Class A Misdemeanor Theft in Washington County Circuit Court. 30 CONCLUSIONS OF LAW 31 ORS 342. 175 authorizes Teacher Standards and Practices Commission to impose 32 disciplinary sanctions when an educator is convicted for a crime. ORS 670.280 33 requires the Commission to consider the relationship of the conviction to fitness to 34 serve as an educator. .
