The Notice was sent via U.S. First Class Mail 11 and U.S. Certified Mail Receipt 7006 0810 0001 4602 2234 to the address Mr. Heath provided to the 12 Commission. The U.S. First Class Mail was signed by Mr. Heath and returned to the Commission on 13 January 10, 2008. The Notice of Opportunity of Hearing, dated January 7, 2008, and signed by 14 Victoria Chamberlain, Executive Director, stated: 15 "You, Nathan Franz Heath, are entitled to a hearing on the proposed action of the 16 Commission. If you want a hearing, you must file a written request for a hearing with 17 the Commission within 21 days of the date of this notice. Attached to this notice is a 18 copy of the procedures, right of representation and other rights of parties relating to the 19 conduct of a hearing as required under ORS 183.413(2).” 5(1) Mr. Heath did not request a hearing. The Commission, therefore, finds 22 Mr. Heath to be in default and enters the following findings of fact, conclusions of law and 23 order, based on the files and records of the Commission concerning this matter. 24 FINDINGS OF FACT 25 1. Mr. Heath has been licensed by the Commission since June 28, 1999. The Commission 26 issued Mr. Heath an Initial I Teaching License on June 5, 2003, with Multiple Subjects and Multiple 27 Subjects Self-Contained Endorsements. Said license expired June 17, 2007. 28 2. On February 13, 2006, Mr. Heath was convicted in Idaho of Injury to a Child 29 (LC. 18-1501(1) a first degree felony sex offense. 30 / // 31 /// _ 32 /// 1 — DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY — HEATH 1 CONCLUSIONS 0F LAW 2 Mr. Heath's conviction in Idaho of Injury to a Child (I.C.18-150(1) a first degree felony sex 3 offense is listed in ORS 342.143(3). The Commission is required to revoke Mr. Heath’s right to apply 4 for a license pursuant to ORS 342.175(2).
