1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ' OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE REVOCATION AND 6 Adam Ornelas Campos ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE 8 9 On February 19, 2004, the Teacher Standards and Practices Commission (Commission) 10 issued a Notice of Opportunity for Hearing to Adam Ornelas Campos (Campos) in which the 11 Commission charged him with conviction of a crime listed in ORS 342.143(3). The Notice was 12 sent via U.S. Certified Mail Receipt #7002 3150 0004 3437 3437 to the address obtained by the 13 Commission. The certified mail receipt was signed by Tami A. Kelley, agent for Coffee Creek 14 Correctional Facility and returned to the Commission on February 24, 2004. The Notice of 15 Opportunity of Hearing, dated February 19, 2004, and signed by Victoria Chamberlain, 16 Executive Director, stated: Q "You, Adam Ornelas Campos, are entitled to a hearing on the proposed action of t the Commission. If you want a hearing, you must file a written request for a 19 hearing with the Commission within 21 days of the date of this notice. Attached 20 to this notice is a copy of the procedures, right of representation and other rights 21 of parties relating to the conduct ofa hearing as required under ORS 22 183.413(2)." 23 ' 24 Mr. Campos did not request a hearing. The Commission, therefore, finds 25 Mr. Campos to be in default and enters the following findings of fact, conclusions of law 26 and order, based on the files and records of the Commission concerning this matter. 27 FINDINGS OF FACT 28 1. Mr. Campos holds an Initial Teaching License issued August 27, 2003, valid until 29 May 9, 2007. 30 2. Mr. Smith served as a teacher for Portland Public Schools from August 29, 2000, until 31 placed on unpaid administrative leave effective December 2, 2003. . On January 29, 2004, Adam Ornelas Campos was convicted of two counts of .2 Unlawful Sexual Penetration I, ORS 163.411, and Sodomy I, ORS 163.405 in the Circuit Court 3 of the State of Oregon for the County of Yamhill. 4 CONCLUSIONS OF LAW 5 The crimes of Unlawful Sexual Penetration l as defined In ORS 163.411 and Sodomy I 6 as defined in ORS 163.405 are listed in ORS 342.143(3).
