l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the Teaching License of 5 ' ‘ STIPULATION OF FACTS ‘ 6 ELLEN MARGARET IRISH AND PROBATION l 7 On or about July 9, 2001, the Teacher Standards and Practices Commission (Commission) 8 received an application for a Substitute Teaching License fi'om Ellen Margaret Irish (Irish). 9 Ms. Irish responded “yes” to character question l “Have you ever lefi any educational or ‘ 10 school-related employment, voluntarily or involuntarily, while the subject of an inquiry, review ll or investigation of alleged misconduct or alleged violation of professional standards of conduct 12 or when you had reason to believe such investigation was imminent?” Ms. Irish responded “yes” ' 13 to character question 3 “Have you ever failed to complete a contract for educational services in l4 any educational or school-related position, or for any alleged misconduct or alleged violation of 15 professional standards of conduct been placed on leave by your employer or left such l6 employment prior to the end of the contract term?” Ms. Irish responded “yes” to character 17 question 4 “Have you ever had a professional certificate, credential or license (of any kind) l8 revoked or suspended or have you been placed on probationary status for any alleged misconduct 19 or alleged violation of professional standards of conduct?” Ms. Irish responded “yes” to 20 character question 7 “Have you ever been disciplined by any public agency responsible for _ 21 licensure of any kind, including but not limited to educational licensure?” Ms. Irish responded 22 “yes” t0 character question 8 “Have you ever been convicted or been granted conditional 23 discharge by any court for: (a) any felony; (b) misdemeanor; or (c) any major traffic violation, Page l - STIPULATION OF FACTS AND PROBATION-Ellen Irish 1 such as: driving under the influence of intoxicants or drugs; reckless driving; fleeing from or ' 2 attempting to elude a police officer; driving while your license was suspended, revoked or used 3 in violation of any license restriction; or failure to perform the duties of a driver or witness at an 4 accident?” Ms. Irish also responded “yes” to character question 10 “Have you ever entered a 5 plea of guilty or No Contest relative to any charge for an offense listed in question 8?” Ms. Irish 6 submitted a written explanation of her “yes” answers and documentation from Josephine County 7 Circuit Court. On December 20, 2001, Ms. Irish submitted a personal affidavit and supporting 8 documentation to establish that she has the qualifications required for reinstatement. 9 After review of the facts in this matter, Ms. Irish and the Executive Director agree that 10 their respective interests, together with the public interests, are best served by a stipulation to ll certain facts, followed by a probation of four (4) years. 12 This Order sets forth the facts upon which the parties have agreed and the sanction to be . l3 imposed. In entering into this stipulation, Ms. Irish waives the right to a hearing to contest the 14 findings of fact, conclusion of law and order set forth below. Ms. Irish understands that the 15 Commission will impose a four (4) year probation with specific conditions. 16 This stipulation is contingent upon approval and adoption of the Order by the 17 Commission. If the Commission does not adopt this Order, neither Ms. Irish nor the 18 Commission are bound by these stipulations and Ms. Irish retains all rights to a hearing on the l9 allegations. 20 STIPULATION OF FACTS 21 l. I On or about July 9, 2001 , the Commission received an application for a Substitute 22 Teaching License from Ellen Irish. . 23 /// Page 2 - STIPULATION OF FACTS AND PROBATION-Ellen Irish ’ 1 2. Ms. Irish previously held a Basic Teacher License valid from June 6, 1986, 2 through April 11, 1994. On September 8, 1994, Ms. Irish was issued a Standard Teacher License 3 with a Standard Advanced Mathematics endorsement effective through April 11, 2000. 4 3. On July 9, 1996, Ms. Irish was convicted of the crime of Manufacture of a 5 Controlled Substance - Methamphetamine ORS 475.992 in Josephine County Circuit Court. Ms. 6 Irish was sentenced to l8 months in prison and 36 months Post-Prison Supervision. 7 4. On May 24, 1996, the Commission revoked the Oregon Teaching License of 8 Ellen Irish as per ORS 342.175(1)(d) conviction of a crime involving the illegal use, sale or 9 possession of a controlled substance. 10 5. Ms. Irish has submitted an affidavit and extensive documents in support of her 11 application for reinstatement. This information indicates that Ms. Irish has stabilized her life and l2 has become a reliable person who interacts appropriately with children and teenagers. Since ' 13 August 1998, Ms. Irish has been employed by the Ecumenical Ministries of Oregon, Portland 14 Intemational Community School where she served as a Math Teacher and Program Director. 15 She is currently serving as Principal/Program Director. 16 CONCLUSIONS OF LAW 17 Ms. Irish has provided sufficient evidence to establish convincingly that she possesses the l8 qualifications required for reinstatement of her Oregon Teaching License. l 9 20 fink Wflgdw \’Lbi()2- Ellen Margaret Irish Date 21 /Q ‘ 22 MZLDW 5% 23 Teacher Standards and ractices Commission O Page 3 - STIPULATION OF FACTS AND PROBATION-Ellen Irish . 1 ORDER 2 The Oregon Teaching License of Ellen Margaret Irish is hereby reinstated subject to all 3 standard terms and conditions and subject to the following special terms of probation: 4 l. The Commission places Ms. Irish on a four (4) year probation to commence on the date 0f 5 issuance of this Order. 6 2. The probation shall remain in effect subject to the following conditions: 7 a. Ms. Irish shall conduct herself as a law-abiding citizen; 8 b. Ms. Irish shall report in writing within ten days to the Executive Director of the 9 Commission any arrest or citation for any felony, misdemeanor, major traffic 10 violation; 11 c.
