. \ 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION . 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REPRIMAND g GLENN ALAN AMELING g AND PROBATION 7 On or about September 3, 2001, the Teacher Standards and Practices Commission 8 (Commission) received a report from Cheryl Crawley, Superintendent, The Dailes School 9 District indicating that the District recently completed an investigation of allegations of sexual 10 harassment filed against Glenn Ameling. 11 Mr. Ameling fully cooperated with the Commission's investigation. After review of the 12 matters alleged, Mr. Ameling and the Commission agree that their respective interests, together 13 with the public interest, are best sen/ed by a stipulation to certain facts and the imposition of a 14 Public Reprimand, followed by a period of probation of two (2) years. This Order sets forth the ‘i 15 facts upon which the parties have agreed and the sanction to be imposed. In entering into this 16 stipulation, Mr. Ameling waives the right to a hearing to contest the findings of fact, conclusion 17 of law and order set forth below. Mr. Ameling understands that the probation will be subject to 18 specific conditions. 19 STIPULATION OF FACTS 20 1. Mr. Ameling holds a Standard Oregon Teaching License with Standard Social 21 Studies and Basic Spanish Endorsements issued on October 19, 1999 valid until October 5, 22 2004. There are no prior complaints in his licensure file. 23 2. Mr, Ameling was employed by The Dailes School District, teaching Spanish and 24 Social Studies at The Dailes High School from 1987 until resignation effective June 14, 2001. 25 3. Mr. Ameling was issued a directive on May 16, 1999 and Reprimanded on 26 November 6, 2000, for his inappropriate communication with students. On June 8, 2001, the .t 27 District hired an independent consultant to conduct an investigation of allegations that Page 1 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION 1 Mr. Ameling made inappropriate comments in the classroom. Mr. Ameling admitted to the ' 2 investigator that he made inappropriate remarks to both male and female students in the 3 classroom, briefly touched both male and female students on the shoulders or upper back 4 during class, and occasionally came within their personal space. A majority of the remarks 5 were directed to students about their names or appearance. Some of the students were 6 embarrassed and offended by Mr. Ameling’s remarks. 7 4. In addition to cooperating with the District and the Commission Mr. Ameling has 8 initiated personal counseling with a licensed psychologist. 9 5. Mr. Ameling accepts responsibility for his behavior and acknowledges that he is now 10 fully aware that his behavior was inappropriate. 11 This stipulation is contingent upon approval and adoption of the Order by the 12 Commission. if the Commission does not adopt this Order, neither Mr. Ameling nor the 13 Commission are bound by these Stipulations and Mr. Ameling retains all rights to a hearing on ‘ 14 the allegations. 15 IT IS SO STIPULATED: 16 . c 17 a /»2%2/4@/ 18 enn Alan Ameli Date 19 20 _ 21 ML 4% 22 DaVId V. Myton Ex cutlve Di ector Date 23 Teacher Standards and Practices Commission 24 CONCLUSIONS OF LAW 25 Mr. Ameling’s inappropriate comments to students in the classroom violate Standards 26 set forth in OAR 584-020-0030(1) and (2)(b). In his comments to students about their 27 appearance and their names Mr. Ameling violated OAR 584-020-0010(5) as he failed to use 28 professional judgment. Both of these issues are grounds for a finding of Gross Neglect of duty ' 29 under OAR 584-020-0040. Page 2 STIPULATION OF FACTS, ORDER OF REPRIMAND AND PROBATION 1 ORDER ' 2 The Commission imposes a Public Reprimand on Mr. Ameling. This Stipulation of 1 i 3 Facts, Order and Probation constitutes the Reprimand. Furthermore, the Commission imposes 4 a two (2) year probation upon Mr. Ameling subject to the following conditions: 5 1. Mr. Ameling shall at his own expense, participate in an intensive education program 6 regarding appropriate boundaries with students conducted by a qualified trainer approved in 7 advance by the Commission. This intensive training shall consist of at least five (5) one and 8 one-half (1 1/2) hour sessions, or eight (8) one (1) hour sessions, or some combination thereof 9 totaling at least 5 sessions and seven and one-half hours (e.g. two 1 1/2 hour sessions and five 10 1-hour sessions). The educator will provide the trainer with a copy of this Order and a copy of 11 Randy Harvey’s July 17, 2001 investigation report and grid. As a condition of probation the 12 educator shall complete the education program within six (6) months of the date of this order. 13 The program trainer will provide the Commission with a report of successful program . 14 completion. Such report need not contain assessment or evaluative information; it should only 15 confirm successful completion of the terms required by this paragraph. 16 2.
