' 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON i 5 In the Matter of the | 6 Teaching License of | DEFAULT ORDER 7 PAUL RAYMOND YAUCH | OF REVOCATION g l 10 11 On July 18, 2001, the Teacher Standards and Practices Commission issued a Notice 12 of Opportunity for Hearing to Paul Raymond Yauch, in which the Commission proposed to 13 suspend or revoke the teaching license of Paul Yauch or otherwise impose discipline under l4 ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 15 #7000 0600 0023 8496 7996 to the address Paul Yauch provided to the Commission. The 16 notice sent via certified mail was returned to the Commission on August 6, 2001, as 17 unclaimed. The notice sent via U.S. First Class Mail has not been returned. Paul Yauch did 18 not request a hearing. 19 :20 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive 21 Director, stated: 22 If a request for hearing is not received within this 21-day period, your right to 23 hearing shall be considered waived unless your failure to request a hearing was 24 beyond your reasonable control. If you do no request a hearing or if you fail to 25 appear at a hearing, the Commission will adopt an Order of Default which may 26 include the revocation or suspension of your license or other discipline. 27 28 Based on the foregoing, the Commission finds Paul Raymond Yauch in default and 29 such default is hereby entered. Paul Raymond Yauch holds a Basic Teaching License with an endorsement in 4 Basic Elementary valid through January 15, 2002. Paul Yauch has been licensed by TSPC 5 since September 1974. 6 7 2. Paul Raymond Yauch was employed by Portland Public Schools at Beaumont 8 Middle School since January 1975. Paul Yauch’s resigned before the School Board took 9 any action. 10 11 3. On September 27, 2000, Police arrested Paul Yauch engaged in a drug deal near 12 SE 92“d Avenue and Powell Boulevard in Portland. 1 3 14 4. On October 5, 2000, the Multnomah County Grand Jury indicted Paul Yauch on 15 charges of: ORS 475.999 i Delivery of a Controlled Substance within 1000 Feet School; ' 16 ORS 475.999 — Delivery of a Controlled Substance Schedule II; and 17 ORS 475.999 — Possession of a Controlled Substance Schedule II l 8 19 5. On April 17, 2001, Paul Yauch pled guilty and was convicted of Delivery of a 20 Controlled Substance II (Commercial Drug Offense; Substantial Quantities) in Multnomah 21 County Circuit Court for delivery of IO or more grams of a mixture or substance containing 22 detectable amounts of cocaine.
