BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON ~ In the Matter of the ) Teaching License of ) DEFAULT ORDER CHRISTINE ELAINE BARBER ) REVOKING LICENSE ) On or about June 6, 1996, the Teacher Standards and Practices Commission received information from Detective Steve Smith of the Salem Police Department, indicating that Christine Elaine Barber, a licensed teacher in the Salem-Keizer School District was under investigation for allegations of falsification of college transcripts and that his investigation revealed the transcripts in question were forgeries. On January 17, 1997 the Commission took action to charge Barber with violation of TSPC Standards. The Executive Secretary notified Barber of the Commission's intent to revoke her Oregon Teaching license. informed her of her opportunity for hearing. The notice, dated January 30, 1997, and signed by David V. Myton. Executive Secretary, stated: "You, Christine Elaine Barber, are entitled to a hearing on the proposed action of the Commission. of your license. If you desire a hearing, you must notify the Executive Secretary of the Commission, in writing, within 21 days of the date of this notice." The Notice of Opportunity for Hearing was sent by U.S. Certified Mail, Return Receipt Requested. By letter dated February 18, 1997, Barber's Attorney, Neil Lathan informed TSPC that Barber would not request a hearing with the understanding that a. die Commission would adopt a default order revoking Barber's Oregon Teaching License. . FINDINGS OF FACT 1. On December 20, 1992. Barber applied for a Health Occupation teaching position with the Salem-Keizer School District. In her application Barber indicated she was a Nurse Practitioner and had earned a Master's Degree in Nursing. A criminal investigation by the Salem Police Department revealed that Barber's statements were not truthful. 2. On January 18, 1993, Christine Elaine Barber submitted an application for an Oregon Teaching License. Barber was issued a Three Year Professional Technical Teaching License endorsed in Health Occupations. 3. Barber falsified her application to TSPC in that she indicated she held an Oregon Nursing License and a Master's Degree in Nursing from the University of Pittsburgh. A criminal investigation by the Salem Police Department revealed Barber did not possess these credentials. PAGE 1—-PROPOSED ORDER--CHRISTINE ELAINE BARBER 4. On October 15, 1996. Barber plead guilty and was convicted of Unsworn Falsification (ORS 162.085) in Marion County District Court. ULTIMATE FINDINGS OF FACT Christine Elaine Barber knowingly falsified documents directly related to licensure and employment as an educator. Barber plead guilty and was convicted of Unsworn Falsification in Marion County District Court on October l5, 1996. CONCLUSIONS OF LAW Christine Elaine Barber's conduct constitutes gross neglect of duty under OAR 584- 20-040(4)(c) and gross unfitness under OAR 584-20-040(5)(b) and (e).
