Bi 5 CHRISTINE ANDERSON EBERLE ) PUBLIC REPRIMAND Practices Commission 6 On or about August 9, 2013 the Teacher Standards and Practices Commission (Commission) 7 received a report from Mike Scott, Superintendent of the Hillsboro School District indicating that 8 Christine Anderson Eberle (Eberle) had violated relevant standards for competent and ethical 9 performance of Oregon educators. 1 0 Eberle fully cooperated with the Commission's investigation in this matter. Afier review of the 1 1 matters alleged, Eberle and the Commission agree that their respective interests, together with the 12 public interest, are best served by a stipulation to certain facts, the imposition of Public Reprimand of 1 3 her educator license. 14 This document sets forth the facts upon which the parties have agreed and the stipulated 1 5 sanction to be imposed. Eberle stipulates that there is sufficient evidence in the Commission’s files 16 and records to support the findings of fact, conclusions of law, and order set forth below. 17 By signing below, Eberle acknowledges, understands, stipulates, and agrees to the following: 1 8 (i) she has been fully advised of her rights to notice and a hearing to contest the findings of fact, 1 9 conclusions of law, and order set forth below, and fully and finally waives all such rights and any rights 20 to appeal or otherwise challenge this Stipulation of Facts and Final Order of Reprimand (Stipulation 21 and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to the public 22 upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon and subject 23 to approval and adoption by the Commission. Eberle currently holds a Standard 6 Teaching License issued July 8, 2013, with endorsements in Basic language Arts (020) and 7 Standard Exceptional learner (018), which expires on July 7, 2018. During all relevant times, 8 Eberle was employed by the Hillsboro School District 9 2) On August 9, 2013, the Commission received a district report indicating Eberle may have 10 committed acts which constitute gross neglect of duty relating to her duties as a special education 1 1 teacher. The District’s audit of Eberle’s special education paperwork revealed irregularities in how 12 she convened and recorded various special education meetings. Specifically, on three occasions, 13 Eberle wrote the names of SPED team members on meeting minutes in her own writing, rather 14 than obtaining their signature. In addition, on three occasions, Eberle had not properly convened 15 a formal meeting and had not obtained formal input from other staff, as required by state and 16 federal law. Eberle cooperated with both the District and TSPC investigation and accepted a three 1 7 day unpaid suspension by the district. While she disputed certain aspects of the District’ s 18 discipline, Eberle aelmowledged that she violated the relevant law when she held an IEP meeting 19 by telephone at the parents’ request, rather than reschedule when other team members could 20 attend.
