OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND g STEVEN JOHN SIMMON ) ORDER OF PROBATION 7 On April 19, 2003, Steven John Simmon (Simmon) submitted a complete application for a 8 Transitional Teaching License to the Teacher Standards and Practices Commission (Commission). 9 Mr. Simmon responded affirmatively to character question number 1. Mr. Simmon provided an 10 explanation regarding his separation from employment with the American School for the Deaf in West 11 Hartford, Connecticut. 12 Mr. Simmon fully cooperated with the Commission's investigation. After review of the facts in 13 this matter, Mr. Simmon and the Executive Director agree that their respective interests, together with 14 the public interests, are best served by a stipulation to certain facts and an Order imposing a three (3) 15 year probation upon issuance of a teaching license. 1‘ This Order sets forth the facts upon which the parties have agreed and the sanction to be 17 imposed. Mr. Simmon stipulates that there are sufficient facts contained in the Commission's files 18 and records to support the findings of fact and conclusions of law set forth below. In entering into this 19 stipulation, Mr. Simmon waives the right to a hearing to contest the findings of fact, conclusions of law 20 and order set forth below. Mr. Simmon enters into this agreement with the knowledge that the 21 Commission will impose a three (3) year probation with specific conditions including the requirement 22 that Mr. Simmon complete an anger management program or participate in anger management 23 counseling within the first 12 months of said probation. 24 This stipulation is contingent upon approval and adoption of the Order by the Commission. If 25 the Commission does not adopt this Order, neither Mr. Simmon nor the Commission are bound by 26 these Stipulations and Mr, Simmon retains all rights to a hearing on the allegations. . On April 19, 2003, Mr. Simmon submitted a complete Application for Educator License Form 3 C-1 to the Commission. He responded affirmatively to character question number 1. 4 Mr. Simmon provided information to the Commission indicating that he was terminated from school- 5 related employment for failure to comply with prior directives and failure to incorporate prior training. 6 2. At the request of the Executive Director, Mr. Simmon sought a psychological evaluation from 7 a Commission approved provider. 8 3. On March 18, 2004, the Commission received an evaluation summary from John B. Nance, 9 Ph.D., Psychologist, recommending that Mr. Simmon pursue anger issues through a counseling 1O program. 11 IT IS SO STIPULATED: 12 . 13 m I‘ k ‘It/:21 0'1 14 Steven John Simmon Date Q 16 W 5-2104 17 Victoria Cha rIain, Executive Director Date 18 CONCLUSION OF LAW 19 The documentation provided by Mr. Simmon regarding his behavior while employed at the 20 American School for the Deaf in West Hartford, Connecticut, specifically the failure to comply with 21 prior directives and failure to incorporate prior training in school related employment, may be used as 22 evidence to establish an applicant’s lack of fitness to serve as an educator pursuant to OAR 584-050- 23 0006(5), a basis for denial of Iicensure. The Commission's authority to impose discipline in this matter 24 is based upon ORS 342.143. 25 // / 26 /// l ‘ /// Page 2 STIPULATION OF FACTS AND ORDER OF PROBATION - SIMMON 1 ORDER . The Commission adopts the above Stipulation of Facts and authorizes the issuance of a 3 Transitional Teaching License to Mr. Simmon subject to all standard terms and conditions. 4 Furthermore, the Commission imposes a three (3) year probation upon Mr. Simmon to 5 commence the date of issuance of said license and subject to the following special terms of probation: 6 1. Mr. Simmon shall submit, within the first 12 months of said probation, documentation that 7 he has completed (at his own expense), an intensive anger management program conducted by a 8 qualified counselor approved in advance by the Commission. This counseling shall consist of, a 9 minimum of nine (9) contact hours. The Commission shall provide the counselor with a copy of this 1O Order. Mr. Simmon shall be responsible for providing evidence to the Commission of successful 1 1 compliance with treatment or program completion. 12 2. Mr. Simmon shall report in writing within ten days, to the Executive Director of the 13 Commission any allegation of misconduct against him in his employment as an educator; and ' 3.
